 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the allocation of funding for certain programs
1-11     maintained by the Texas Department of Housing and Community Affairs
1-12     to the uniform state service regions.
1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14           SECTION 1.  Section 2306.111, Government Code, is amended by
1-15     adding Subsections (d), (e), and (f) to read as follows:
1-16           (d)  The department shall allocate housing funds provided to
1-17     the state under the Cranston-Gonzalez National Affordable Housing
1-18     Act (42 U.S.C. Section 12701 et seq.), housing trust funds
1-19     administered by the department under Sections 2306.201-2306.206,
1-20     and commitments issued under the federal low income housing tax
1-21     credit program administered by the department under Sections
1-22     2306.671-2306.678 to each uniform state service region using a
1-23     formula developed by the department that is based on the proportion
1-24     of households in each region that are in need of housing
1-25     assistance, provided that the allocations are consistent with
1-26     applicable federal and state requirements and limitations.  If the
1-27     department determines under the formula that an insufficient number
1-28     of eligible applications for assistance out of funds and credits
1-29     allocable under this subsection are submitted to the department
1-30     from a particular uniform state service region, the department
1-31     shall use the excess funds and credits allocated to that region for
1-32     other set-asides.
1-33           (e)  The department shall include in its annual low income
1-34     housing plan under Section 2306.0721:
1-35                 (1)  the formula developed by the department under
1-36     Subsection (d); and
1-37                 (2)  the allocation targets established under the
1-38     formula for each uniform state service region.
1-39           (f)  The department shall include in its annual low income
1-40     housing report under Section 2306.072 the amounts of funds and
1-41     credits allocated to each uniform state service region in the
1-42     preceding year for each federal and state program affected by the
1-43     requirements of Subsection (d).
1-44           SECTION 2.  This Act takes effect September 1, 2000.
1-45           SECTION 3.  The importance of this legislation and the
1-46     crowded condition of the calendars in both houses create an
1-47     emergency and an imperative public necessity that the
1-48     constitutional rule requiring bills to be read on three several
1-49     days in each house be suspended, and this rule is hereby suspended.
