                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to an exception to the offense of contributing to the
 1-3     delinquency of a narcotic addict.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 463, Health and Safety
 1-6     Code, is amended by adding Section 463.013 to read as follows:
 1-7           Sec. 463.013.  EXCEPTION.  (a)  In this section, "informant"
 1-8     means a person who has communicated information to a law
 1-9     enforcement official in  connection with a law enforcement
1-10     function.
1-11           (b)  It is an exception to the application of Section
1-12     463.011(b) that the person is a law enforcement official and the
1-13     narcotic addict is an informant.
1-14           SECTION 2.  (a)  This Act takes effect September 1, 1999.
1-15           (b)  The change in law made by this Act applies to an offense
1-16     committed before, on, or after the effective date of this Act.
1-17     However, a final conviction for an offense under Section 463.011,
1-18     Health and Safety Code, that exists on the effective date of this
1-19     Act is unaffected by this Act.
1-20           SECTION 3.  The importance of this legislation and the
1-21     crowded condition of the calendars in both houses create an
1-22     emergency and an imperative public necessity that the
1-23     constitutional rule requiring bills to be read on three several
1-24     days in each house be suspended, and this rule is hereby suspended.
