No. 1116 1-2 (In the Senate - Filed March 10, 1999; March 11, 1999, read 1-3 first time and referred to Committee on Criminal Justice; 1-4 April 8, 1999, reported favorably by the following vote: Yeas 7, 1-5 Nays 0; April 8, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to an exception to the offense of contributing to the 1-9 delinquency of a narcotic addict. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter B, Chapter 463, Health and Safety 1-12 Code, is amended by adding Section 463.013 to read as follows: 1-13 Sec. 463.013. EXCEPTION. (a) In this section, "informant" 1-14 means a person who has communicated information to a law 1-15 enforcement official in connection with a law enforcement function. 1-16 (b) It is an exception to the application of Section 1-17 463.011(b) that the person is a law enforcement official and the 1-18 narcotic addict is an informant. 1-19 SECTION 2. (a) This Act takes effect September 1, 1999. 1-20 (b) The change in law made by this Act applies to an offense 1-21 committed before, on, or after the effective date of this Act. 1-22 However, a final conviction for an offense under Section 463.011, 1-23 Health and Safety Code, that exists on the effective date of this 1-24 Act is unaffected by this Act. 1-25 SECTION 3. The importance of this legislation and the 1-26 crowded condition of the calendars in both houses create an 1-27 emergency and an imperative public necessity that the 1-28 constitutional rule requiring bills to be read on three several 1-29 days in each house be suspended, and this rule is hereby suspended. 1-30 * * * * *
