                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the jurisdiction of statutory probate courts.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  Section 25.0021, Government Code, is amended to
 1-4     read as follows:
 1-5           Sec. 25.0021.  JURISDICTION.  (a)  If a provision of this
 1-6     subchapter conflicts with a specific provision for a particular
 1-7     court or county, the specific provision controls except that this
 1-8     subchapter controls over a specific provision for a particular
 1-9     court or county if the specific provision attempts to create
1-10     jurisdiction in a statutory probate court other than jurisdiction
1-11     over probate, guardianship, mental health, or eminent domain
1-12     proceedings.
1-13           (b)  A statutory probate court as that term is defined in
1-14     Section 3(ii), Texas Probate Code, has the general jurisdiction of
1-15     a probate court as provided by the Texas Probate Code.
1-16           SECTION 2.  Section 25.00266, Government Code, and Section
1-17     25.0032, Government Code, as added by Chapter 394, Acts of the 72nd
1-18     Legislature, Regular Session, 1991, are repealed.
1-19           SECTION 3.  This Act takes effect September 1, 1999.
1-20           SECTION 4.  This Act applies only to the jurisdiction of
1-21     cases filed on or after the effective date of this Act.  The
1-22     jurisdiction of a case filed before the effective date of this Act
1-23     is governed by the law as it existed immediately before the
1-24     effective date of this Act, and that law is continued in effect for
 2-1     that purpose.
