No. 1163 1-2 (In the Senate - Filed March 10, 1999; March 11, 1999, read 1-3 first time and referred to Committee on Jurisprudence; 1-4 April 8, 1999, reported favorably by the following vote: Yeas 4, 1-5 Nays 0; April 8, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the jurisdiction of statutory probate courts. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Section 25.0021, Government Code, is amended to 1-11 read as follows: 1-12 Sec. 25.0021. JURISDICTION. (a) If a provision of this 1-13 subchapter conflicts with a specific provision for a particular 1-14 court or county, the specific provision controls except that this 1-15 subchapter controls over a specific provision for a particular 1-16 court or county if the specific provision attempts to create 1-17 jurisdiction in a statutory probate court other than jurisdiction 1-18 over probate, guardianship, mental health, or eminent domain 1-19 proceedings. 1-20 (b) A statutory probate court as that term is defined in 1-21 Section 3(ii), Texas Probate Code, has the general jurisdiction of 1-22 a probate court as provided by the Texas Probate Code. 1-23 SECTION 2. Section 25.00266, Government Code, and Section 1-24 25.0032, Government Code, as added by Chapter 394, Acts of the 72nd 1-25 Legislature, Regular Session, 1991, are repealed. 1-26 SECTION 3. This Act takes effect September 1, 1999. 1-27 SECTION 4. This Act applies only to the jurisdiction of 1-28 cases filed on or after the effective date of this Act. The 1-29 jurisdiction of a case filed before the effective date of this Act 1-30 is governed by the law as it existed immediately before the 1-31 effective date of this Act, and that law is continued in effect for 1-32 that purpose. 1-33 * * * * *
