                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the immunity and liability of a public facilities
 1-3     corporation.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 4.041, Public Facility Corporation Act
 1-6     (Article 717s, Revised Statutes), is amended by adding Subsection
 1-7     (d) to read as follows:
 1-8           (d)  A corporation has the same immunity and may be held
 1-9     liable in the same manner as the corporation's sponsor.  An
1-10     officer, employee, or director of a corporation has the same
1-11     immunity and may be held liable in the same manner as an officer,
1-12     employee, or member of the governing body of the corporation's
1-13     sponsor.
1-14           SECTION 2.  The change in law made by this Act applies only
1-15     to an act of a corporation created under the Public Facility
1-16     Corporation Act (Article 717s, Revised Statutes), or an act of a
1-17     director, officer, or employee of the corporation, that begins on
1-18     or after the effective date of this Act.   An act of a corporation
1-19     created under the Public Facility Corporation Act or an act of a
1-20     director, officer, or employee of the corporation that begins
1-21     before the effective date of this Act is governed by the law in
1-22     effect immediately before the effective date of this Act, and that
1-23     law is continued in effect for that purpose.
1-24           SECTION 3.  The importance of this legislation and the
 2-1     crowded condition of the calendars in both houses create an
 2-2     emergency and an imperative public necessity that the
 2-3     constitutional rule requiring bills to be read on three several
 2-4     days in each house be suspended, and this rule is hereby suspended,
 2-5     and that this Act take effect and be in force from and after its
 2-6     passage, and it is so enacted.
