AN ACT
 1-1     relating to developer participation contracts.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  Section 212.071, Local Government Code, is
 1-4     amended to read as follows:
 1-5           Sec. 212.071.  DEVELOPER PARTICIPATION CONTRACT.  Without
 1-6     complying with the competitive sealed bidding procedure of Chapter
 1-7     252, a municipality with 5,000 [50,000] or more inhabitants may
 1-8     make a contract with a developer of a subdivision or land in the
 1-9     municipality to construct public improvements, not including a
1-10     building, related to the development.  If the contract does not
1-11     meet the requirements of this subchapter, Chapter 252 applies to
1-12     the contract if the contract would otherwise be governed by that
1-13     chapter.
1-14           SECTION 2.  This Act takes effect September 1, 1999.
1-15           SECTION 3.  The importance of this legislation and the
1-16     crowded condition of the calendars in both houses create an
1-17     emergency and an imperative public necessity that the
1-18     constitutional rule requiring bills to be read on three several
1-19     days in each house be suspended, and this rule is hereby suspended.
