 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the approval of budgets of emergency communication
 1-9     districts.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subsections (b), (c), and (d), Section 772.309,
1-12     Health and Safety Code, are amended to read as follows:
1-13           (b)  The governing body of a county, municipality, or other
1-14     participating jurisdiction shall approve the budget unless the body
1-15     finds that the board abused its discretion in preparing the budget.
1-16           (c)  If the governing body of a county, municipality, or
1-17     other participating jurisdiction does not approve or disapprove the
1-18     budget before the 61st day after the date the body received the
1-19     budget for review, the budget is approved by operation of law.
1-20           (d)  A revision of the budget must be approved in the same
1-21     manner as the budget.
1-22           (e) [(c)]  As soon as practicable after the end of each
1-23     district fiscal year, the director shall prepare and present to the
1-24     board and to each participating jurisdiction in writing a sworn
1-25     statement of all money received by the district and how the money
1-26     was used during the preceding fiscal year.  The report must show in
1-27     detail the operations of the district for the fiscal year covered
1-28     by the report.
1-29           (f) [(d)]  The board shall have an independent financial
1-30     audit of the district performed annually.
1-31           SECTION 2.  This Act takes effect September 1, 1999.
