                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a requirement that the photographs of certain sex
 1-3     offenders be published in a newspaper.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 62, Code of Criminal Procedure, as added
 1-6     by Chapter 668, Acts of the 75th Legislature, Regular Session,
 1-7     1997, is amended by adding Article 62.041 to read as follows:
 1-8           Art. 62.041.  SPECIAL PUBLICATION RULES RELATING TO PAROLEES
 1-9     AND PERSONS RELEASED ON MANDATORY SUPERVISION.  (a)  If in
1-10     reviewing a registration form under Article 62.03(e) or 62.04(f)
1-11     the local law enforcement authority determines that the person
1-12     subject to registration is a parolee or person released to
1-13     mandatory supervision,  the authority shall publish notice in the
1-14     same manner as if the authority were required to provide notice for
1-15     the person under those articles, except that in addition to
1-16     including in the notice the information required by Articles
1-17     62.03(f) and 62.04(g), as appropriate, the authority shall include
1-18     in the notice the person's photograph.
1-19           (b)  This section applies to any person subject to
1-20     registration who is a parolee or person released to mandatory
1-21     supervision, other than a parolee or a person released to mandatory
1-22     supervision who is released after serving a sentence for an offense
1-23     under Section 25.02, Penal Code.  The local law enforcement
1-24     authority shall publish notice as required by Subsection (a)
 2-1     regardless of the age of the victim of the person's offense.
 2-2           SECTION 2.  Article 62.08, Code of Criminal Procedure, is
 2-3     amended by adding Subsection (f)  to read as follows:
 2-4           (f)  Notwithstanding Subsection (b), the photograph of a
 2-5     parolee or person released to mandatory supervision who is
 2-6     described by Article 62.041  is public information.
 2-7           SECTION 3.  This Act takes effect September 1, 1999, and
 2-8     applies only to a person released on parole or mandatory
 2-9     supervision on or after that date.
