No. 1288 1-2 (In the Senate - Filed March 11, 1999; March 15, 1999, read 1-3 first time and referred to Committee on Education; April 29, 1999, 1-4 reported favorably by the following vote: Yeas 5, Nays 0; 1-5 April 29, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the establishment and operation of a campus extension 1-9 of The University of Texas Health Science Center at San Antonio. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Chapter 74, Education Code, is amended by adding 1-12 Subchapter M to read as follows: 1-13 SUBCHAPTER M. UNIVERSITY OF TEXAS HEALTH SCIENCE CENTER AT 1-14 SAN ANTONIO CAMPUS EXTENSION 1-15 Sec. 74.701. AUTHORITY TO ESTABLISH CAMPUS EXTENSION. The 1-16 board of regents of The University of Texas System shall establish 1-17 and operate a campus extension of The University of Texas Health 1-18 Science Center at San Antonio in the city of Laredo if: 1-19 (1) a public or private entity offers the board of 1-20 regents sufficient land in that city to construct a campus 1-21 extension; and 1-22 (2) public or private entities agree to provide funds 1-23 necessary to construct an administrative building for the campus 1-24 extension. 1-25 Sec. 74.702. MANAGEMENT AND OPERATION OF CAMPUS EXTENSION. 1-26 (a) The board of regents may exercise any power granted to the 1-27 board under Subchapter D in establishing and operating the campus 1-28 extension. 1-29 (b) The board of regents shall assign responsibility for 1-30 management of the campus extension to The University of Texas 1-31 Health Science Center at San Antonio. 1-32 (c) The operating costs of the campus extension shall be 1-33 paid from the operating funds of The University of Texas Health 1-34 Science Center at San Antonio for that purpose and from available 1-35 funds from any public or private entity. 1-36 (d) The campus extension may be used to provide 1-37 undergraduate and graduate medical and dental education, including 1-38 residency training programs, and other levels of health education 1-39 work in collaboration with Texas A&M International University or 1-40 any component institution of The Texas A&M University System or The 1-41 University of Texas System. 1-42 Sec. 74.703. GIFTS AND GRANTS. The board of regents may 1-43 accept and administer gifts and grants from any public or private 1-44 person or entity for the use and benefit of the campus extension. 1-45 Sec. 74.704. FACILITIES. (a) The physical facilities of 1-46 the campus extension used in teaching and research programs, 1-47 including libraries, auditoriums, research facilities, and health 1-48 education buildings, may be provided by a public or private entity. 1-49 A physical facility may be constructed, maintained, or operated 1-50 with state money appropriated for that purpose. 1-51 (b) A teaching hospital considered suitable by the board of 1-52 regents may be provided by a public or private entity. The 1-53 hospital may not be constructed, maintained, or operated with state 1-54 funds. 1-55 Sec. 74.705. COORDINATING BOARD SUPERVISION. The campus 1-56 extension is subject to the continuing supervision of the Texas 1-57 Higher Education Coordinating Board under Chapter 61 and to the 1-58 rules of the coordinating board adopted under Chapter 61. 1-59 SECTION 2. (a) Not later than January 1, 2000, the Texas 1-60 Higher Education Coordinating Board shall prepare an impact 1-61 statement examining the initial implementation of this Act and 1-62 shall deliver a copy of the statement to the board of regents of 1-63 The University of Texas System and to the chairs of the standing 1-64 committees of each house of the legislature with primary 2-1 jurisdiction over higher education. 2-2 (b) Not later than December 1, 1999, the board of regents of 2-3 The University of Texas System shall report to the Texas Higher 2-4 Education Coordinating Board if the conditions of Section 74.701, 2-5 Education Code, as added by this Act, relating to the provision of 2-6 land and an administrative building to the board of regents, have 2-7 been satisfied. 2-8 SECTION 3. This Act takes effect September 1, 1999. 2-9 SECTION 4. The importance of this legislation and the 2-10 crowded condition of the calendars in both houses create an 2-11 emergency and an imperative public necessity that the 2-12 constitutional rule requiring bills to be read on three several 2-13 days in each house be suspended, and this rule is hereby suspended. 2-14 * * * * *
