AN ACT
1-1 relating to a prohibition on a requirement for air dispersion
1-2 modeling before beginning construction of a concrete plant.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 382.058, Health and Safety Code, is
1-5 amended by adding Subsection (d) to read as follows:
1-6 (d) If the commission considers air dispersion modeling
1-7 information in the course of adopting an exemption under Section
1-8 382.057 for a concrete plant that performs wet batching, dry
1-9 batching, or central mixing, the commission may not require that a
1-10 person who qualifies for the exemption conduct air dispersion
1-11 modeling before beginning construction of a concrete plant, and
1-12 evidence regarding air dispersion modeling may not be submitted at
1-13 a hearing under Section 382.056.
1-14 SECTION 2. The heading to Section 382.058, Health and Safety
1-15 Code, is amended to read as follows:
1-16 Sec. 382.058. PROVISIONS RELATING TO [LIMITATION ON]
1-17 COMMISSION EXEMPTION FOR CONSTRUCTION OF CERTAIN CONCRETE PLANTS.
1-18 SECTION 3. The importance of this legislation and the
1-19 crowded condition of the calendars in both houses create an
1-20 emergency and an imperative public necessity that the
1-21 constitutional rule requiring bills to be read on three several
1-22 days in each house be suspended, and this rule is hereby suspended,
1-23 and that this Act take effect and be in force from and after its
1-24 passage, and it is so enacted.
