No. 1301 By: Brown 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to water conservation measures required in a county during 1-11 a declared drought disaster. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Section 16.055, Water Code, is amended by adding 1-14 Subsections (g), (h), and (i) to read as follows: 1-15 (g) Immediately upon the declaration under Section 418.014 1-16 or 418.108, Government Code, of a state of disaster in a county due 1-17 to drought conditions, the county shall: 1-18 (1) publish notice of the declaration of the state of 1-19 disaster in one or more newspapers having general circulation in 1-20 the county; and 1-21 (2) give notice of the declaration of the state of 1-22 disaster to: 1-23 (A) the chairman of the regional water planning 1-24 group in which the county is located; and 1-25 (B) each person or entity located in the county 1-26 that is required to develop a water conservation plan under Section 1-27 11.1271 or a drought contingency plan under Section 11.1272. 1-28 (h) On receipt of the notice under Subsection (g)(2)(B), the 1-29 person or entity shall immediately implement the person's or 1-30 entity's water conservation plan or drought contingency plan. 1-31 (i) Nothing in this section prevents a political subdivision 1-32 or a person or entity required to develop a water conservation plan 1-33 under Section 11.1271 or a drought contingency plan under Section 1-34 11.1272 from implementing water conservation measures. 1-35 SECTION 2. This Act takes effect September 1, 1999. 1-36 SECTION 3. The importance of this legislation and the 1-37 crowded condition of the calendars in both houses create an 1-38 emergency and an imperative public necessity that the 1-39 constitutional rule requiring bills to be read on three several 1-40 days in each house be suspended, and this rule is hereby suspended. 1-41 * * * * *
