 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the control of aflatoxin.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  Section 141.002, Agriculture Code, is amended by
1-13     adding Subsection (e) to read as follows:
1-14           (e)  Whole seed and whole grain offered for retail sale for
1-15     wildlife feed are commercial feeds subject to this chapter.
1-16           SECTION 2.  Subchapter A, Chapter 141, Agriculture Code, is
1-17     amended by adding Section 141.007 to read as follows:
1-18           Sec. 141.007.  AFLATOXIN CONTROL.  The service shall
1-19     establish by rule aflatoxin contamination levels considered safe
1-20     for whole seed and whole grain offered for retail sale for wildlife
1-21     feed.
1-22           SECTION 3.  This Act takes effect September 1, 1999.
1-23           SECTION 4.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
1-25     emergency and an imperative public necessity that the
1-26     constitutional rule requiring bills to be read on three several
1-27     days in each house be suspended, and this rule is hereby suspended.
