                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the definition of hazardous waste.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  Section 361.003(12), Health and Safety Code, is
 1-4     amended to read as follows:
 1-5           (12)  "Hazardous waste" means a solid waste, or combination
 1-6     of solid wastes, which because of its quantity, concentration, or
 1-7     physical, chemical, or infectious characteristics may:
 1-8                 (A)  cause, or significantly contribute to an increase
 1-9     in mortality or an increase in serious irreversible, or
1-10     incapacitating reversible, illness; or
1-11                 (B)  pose a substantial present or potential hazard to
1-12     human health or the environment when improperly treated, stored,
1-13     transported, or disposed of, or otherwise managed [identified or
1-14     listed as a hazardous waste by the administrator of the United
1-15     States Environmental Protection Agency under the federal Solid
1-16     Waste Disposal Act, as amended by the Resource Conservation and
1-17     Recovery Act of 1976, as amended (42 U.S.C. Section 6901 et seq.)].
1-18           SECTION 2.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
1-22     days in each house be suspended, and this rule is hereby suspended,
 2-1     and that this Act take effect and be in force from and after its
 2-2     passage, and it is so enacted.
