AN ACT
 1-1     relating to the referral and reporting of delinquent obligations to
 1-2     the attorney general.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 2107.004, Government Code, is amended to
 1-5     read as follows:
 1-6           Sec. 2107.004.  NOTICE TO ATTORNEY GENERAL FOR FURTHER
 1-7     COLLECTION.  Except as provided by Section 2107.003(c), not later
 1-8     than the 120th [30th] day after the date an obligation becomes
 1-9     delinquent or past due or the 30th day after the comptroller
1-10     determines that its efforts to collect [a state agency determines
1-11     that normal agency collection procedures for] an obligation owed
1-12     the agency have failed, the agency shall report the uncollected and
1-13     delinquent obligation to the attorney general for further
1-14     collection efforts.
1-15           SECTION 2.  Section 2107.005, Government Code, is amended to
1-16     read as follows:
1-17           Sec. 2107.005.  REPORTS TO ATTORNEY GENERAL.  The attorney
1-18     general may develop specific reporting procedures for each state
1-19     agency and may adopt rules relating to the reports, including rules
1-20     specifying when an agency must report and what information must be
1-21     included in the report.  Each state agency shall file an annual
1-22     debt report with the attorney general not later than the 90th day
1-23     after the end of each fiscal year.  The report shall contain the
1-24     information required by rules adopted under this section by the
 2-1     attorney general.
 2-2           SECTION 3.  This Act takes effect September 1, 1999.
 2-3           SECTION 4.  The importance of this legislation and the
 2-4     crowded condition of the calendars in both houses create an
 2-5     emergency and an imperative public necessity that the
 2-6     constitutional rule requiring bills to be read on three several
 2-7     days in each house be suspended, and this rule is hereby suspended.
