 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the board of directors of the Lubbock Reese
 1-9     Redevelopment Authority.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 396.003, Local Government Code, is
1-12     amended to read as follows:
1-13           Sec. 396.003.  BOARD.  (a)  The board consists of nine
1-14     members and is responsible for the management, operation, and
1-15     control of the authority.
1-16           (b)  The board is composed of:
1-17                 (1)  two members appointed by the governing body of the
1-18     municipality;
1-19                 (2)  two members appointed by the governing body of the
1-20     county;
1-21                 (3)  one member appointed by the South Plains
1-22     Association of Governments; and
1-23                 (4)  four at-large members appointed by the majority
1-24     vote of the members appointed under Subdivisions (1), (2), and (3).
1-25           (c)  A vacancy on the board is filled in the same manner as
1-26     the original appointment.  In order to implement staggered terms of
1-27     office, beginning on October 1, 1999, at the expiration of the
1-28     terms of office of the initial board, successor members shall be
1-29     appointed to serve as follows:
1-30                 (1)  one of the two members appointed by the governing
1-31     body of the municipality shall be appointed to serve a term of two
1-32     years, and the remaining member shall be appointed to serve a term
1-33     of four years;
1-34                 (2)  one of the two members appointed by the governing
1-35     body of the county shall be appointed to serve a term of two years,
1-36     and the remaining member shall be appointed to serve a term of four
1-37     years;
1-38                 (3)  the member appointed by the South Plains
1-39     Association of Governments shall be appointed to serve a term of
1-40     two years; and
1-41                 (4)  two of the four at-large members appointed by the
1-42     majority vote of the members appointed under Subsections (b)(1),
1-43     (2), and (3) shall be appointed to serve a term of two years, and
1-44     the remaining two members shall be appointed to serve a term of
1-45     four years.
1-46           (e)  At the expiration of the two and four year terms of
1-47     office provided for under Subsections (d)(1)-(4), all following
1-48     terms of office shall be for a period of four years.  A member
1-49     appointed to fill a vacancy for an unexpired term shall serve for
1-50     the remainder of that term only.  A member may be appointed to
1-51     succeed himself or herself on the board [Each board member serves
1-52     for a term of two years].
1-53           (f) [(d)]  The members of the board shall elect from its
1-54     membership a president and a vice president.  The vice president
1-55     shall preside in the absence of the president.
1-56           (g) [(e)]  The board shall adopt rules for its proceedings
1-57     and may employ and compensate persons to carry out the powers and
1-58     duties of the authority.
1-59           SECTION 2.  Section 2311.003, Government Code, is amended to
1-60     read as follows:
1-61           Sec. 2311.003.  Board.  (a)  The board consists of nine
1-62     members and is responsible for the management, operation, and
1-63     control of the authority.
1-64           (b)  The board is composed of:
 2-1                 (1)  two members appointed by the governing body of the
 2-2     city;
 2-3                 (2)  two members appointed by the governing body of the
 2-4     county;
 2-5                 (3)  one member appointed by the South Plains
 2-6     Association of Governments; and
 2-7                 (4)  four at-large members appointed by the majority
 2-8     vote of the members appointed under Subdivisions (1), (2), and (3).
 2-9           (c)  A vacancy on the board is filled in the same manner as
2-10     the original appointment.  In order to implement staggered terms of
2-11     office, beginning on October 1, 1999, at the expiration of the
2-12     terms of office of the initial board, successor members shall be

2-30           (e)  At the expiration of the two and four year terms of
2-31     office provided for under Subsections (d)(1)-(4), all following
2-32     terms of office shall be for a period of four years.  A member
2-33     appointed to fill a vacancy for an unexpired term shall serve for
2-34     the remainder of that term only.  A member may be appointed to
2-35     succeed himself or herself on the board [Each board member serves
2-36     for a term of two years].
2-37           (f) [(d)]  The members of the board shall elect from its

2-40           (g) [(e)]  A majority of the members of the board is a quorum
2-41     for the transaction of business.
2-42           (h) [(f)]  The board shall adopt rules for its proceedings
2-43     and may employ and compensate persons to carry out the powers and
2-44     duties of the authority.
2-45           SECTION 3.  (a)  Except as provided by Subsections (b) and
2-46     (c) of this section, this Act takes effect September 1, 1999.
2-47           (b)  Section 1 of this Act takes effect only if the Act of
2-48     the 76th Legislature, Regular Session, 1999, relating to
2-49     nonsubstantive additions to and corrections in enacted codes takes
2-50     effect.
2-51           (c)  Section 2 of this Act takes effect only if the Act of
2-52     the 76th Legislature, Regular Session, 1999, relating to
2-53     nonsubstantive additions to and corrections in enacted codes does
2-54     not take effect.
2-55           SECTION 4.  The importance of this legislation and the
2-56     crowded condition of the calendars in both houses create an
2-57     emergency and an imperative public necessity that the
2-58     constitutional rule requiring bills to be read on three several
2-59     days in each house be suspended, and this rule is hereby suspended.
