No. 1434 1-2 (In the Senate - Filed March 12, 1999; March 15, 1999, read 1-3 first time and referred to Committee on Finance; April 16, 1999, 1-4 reported favorably by the following vote: Yeas 8, Nays 0; 1-5 April 16, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the retention or refund of certain money collected or 1-9 received by a state agency. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 403.077, Government Code, is amended by 1-12 adding Subsection (f) to read as follows: 1-13 (f) Before paying a refund under this section, the 1-14 comptroller: 1-15 (1) shall: 1-16 (A) credit the amount due to the person claiming 1-17 the refund against any other amount finally determined to be due to 1-18 the state from the person according to information in the custody 1-19 of the comptroller; and 1-20 (B) refund the remainder; and 1-21 (2) may transfer money from one fund or account to 1-22 another for a purpose described by Subdivision (1). 1-23 SECTION 2. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 1-25 emergency and an imperative public necessity that the 1-26 constitutional rule requiring bills to be read on three several 1-27 days in each house be suspended, and this rule is hereby suspended, 1-28 and that this Act take effect and be in force from and after its 1-29 passage, and it is so enacted. 1-30 * * * * *
