                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to minimum salaries for full-time registered nurses
 1-3     employed by school districts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  The heading to Section 21.402, Education Code, is
 1-6     amended to read as follows:
 1-7           Sec. 21.402.  MINIMUM SALARY SCHEDULE [FOR CLASSROOM TEACHERS
 1-8     AND FULL-TIME LIBRARIANS]
 1-9           SECTION 2.  Section 21.402(a), Education Code, is amended to
1-10     read as follows:
1-11           (a)  Except as provided by Subsection (d) or (e), a school
1-12     district must pay each classroom teacher, [or] full-time librarian,
1-13     or full-time registered nurse not less than the minimum monthly
1-14     salary, based on the employee's level of  experience, determined by
1-15     the following formula:
1-16                             MS = SF X (FSP/ADA)
1-17     where:
1-18           "MS" is the minimum monthly salary;
1-19           "SF" is the applicable salary factor specified by Subsection
1-20     (c);
1-21           "FSP" is the amount appropriated in the General
1-22     Appropriations Act for the fiscal year for the Foundation School
1-23     Program, as determined by the commissioner as provided by
1-24     Subsection (b); and
 2-1           "ADA" is the total estimated average daily attendance, as
 2-2     defined by Section 42.005, used for purposes of the General
 2-3     Appropriations Act for the fiscal year.
 2-4           SECTION 3.  Sections 21.403(a) and (c), Education Code, are
 2-5     amended to read as follows:
 2-6           (a)  A teacher, [or] librarian, or registered nurse shall
 2-7     advance one step on the minimum salary schedule under Section
 2-8     21.402 for each year of experience as a teacher, [or] librarian, or
 2-9     registered nurse until step 20 is reached.
2-10           (c)  The commissioner shall adopt rules for determining the
2-11     experience for which a teacher, [or] librarian, or registered nurse
2-12     is to be given credit in placing the teacher, [or] librarian, or
2-13     registered nurse on the minimum salary schedule.  A district shall
2-14     credit the teacher, [or] librarian, or registered nurse for each
2-15     year of experience without regard to whether the years are
2-16     consecutive.
2-17           SECTION 4.  Section 30.102(b), Education Code, is amended to
2-18     read as follows:
2-19           (b)  A classroom teacher, [or] full-time librarian, or
2-20     full-time registered nurse employed by the commission is entitled
2-21     to receive as a minimum salary the monthly salary rate specified by
2-22     Section 21.402.  A classroom teacher, [or] full-time librarian, or
2-23     full-time registered nurse may be paid, from funds appropriated to
2-24     the commission, a salary in excess of the minimum specified by that
2-25     section, but the salary may not exceed the rate of pay for a
2-26     similar position in the public schools of an adjacent school
2-27     district.
 3-1           SECTION 5.  (a)  This Act applies beginning with the
 3-2     1999-2000 school year.
 3-3           (b)  In placing a full-time registered nurse on the minimum
 3-4     salary schedule in accordance with Sections 21.402 and 21.403,
 3-5     Education Code, as amended by this Act, a school district shall
 3-6     credit the registered nurse for each year of experience in
 3-7     accordance with rules adopted by the commissioner of education,
 3-8     regardless of whether the experience was gained before, during, or
 3-9     after the 1999-2000 school year.
3-10           SECTION 6.  The importance of this legislation and the
3-11     crowded condition of the calendars in both houses create an
3-12     emergency and an imperative public necessity that the
3-13     constitutional rule requiring bills to be read on three several
3-14     days in each house be suspended, and this rule is hereby suspended,
3-15     and that this Act take effect and be in force from and after its
3-16     passage, and it is so enacted.
