                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to requiring certified food managers in certain counties.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  Subsection (a), Section 437.0123, Health and
 1-4     Safety Code, is amended to read as follows:
 1-5           (a)  A county that has a population of at least 2.8 million
 1-6     or a public health district at least part of which is in a county
 1-7     that has a population of at least 2.8 million may require the
 1-8     payment of a fee for issuing or renewing a permit or for performing
 1-9     an inspection to enforce this chapter or a rule adopted under this
1-10     chapter.  A county with a population of at least 2.8 million may
1-11     require a trained food manager to be on duty during the operating
1-12     hours of a food service establishment.  The training required of
1-13     food managers can be no more extensive than that specified under
1-14     Subchapter D, Chapter 438.  A food service establishment that
1-15     handles only prepackaged food and does not prepare or package food
1-16     may not be required to have a certified food manager under this
1-17     section.
1-18           SECTION 2.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
1-22     days in each house be suspended, and this rule is hereby suspended.
1-23                          COMMITTEE AMENDMENT NO. 1
1-24           Amend S.B. No. 1477 in SECTION 1 of the bill, in amended
 2-1     Section 437.0123(a), Health and Safety Code (senate engrossment
 2-2     page 1, lines 11 and 12), by striking "the operating hours" and
 2-3     substituting "each day of operation".
