                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to requiring certified food managers in certain counties.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 437.0123(a), Health and Safety Code, is
 1-5     amended to read as follows:
 1-6           (a)  A county that has a population of at least 2.8 million
 1-7     or a public health district at least part of which is in a county
 1-8     that has a population of at least 2.8 million may require the
 1-9     payment of a fee for issuing or renewing a permit or for performing
1-10     an inspection to enforce this chapter or a rule adopted under this
1-11     chapter.  A county with a population of at least 2.8 million may
1-12     require a trained food manager to be on duty during the operating
1-13     hours of a food establishment.  The training required of food
1-14     managers can be no more extensive than that specified under
1-15     Subchapter D, Chapter 438. A food establishment that handles only
1-16     prepackaged food and does not prepare or package food may not be
1-17     required to have a certified food manager under this section.
1-18           SECTION 2.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
1-22     days in each house be suspended, and this rule is hereby suspended.
