                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the condemnation powers of navigation districts, the
 1-2     ability of navigation district or port authorities to form local
 1-3     government corporations and procurement powers of navigation
 1-4     districts.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 62.106, Water Code, is amended by the
 1-7     deletion of subsection (d), as follows:
 1-8           [(d)  No right of way may be condemned through any part of an
 1-9     incorporated city or town without the consent of the lawful
1-10     authorities of that city or town.]
1-11           SECTION 2.  Section 431.003(3), Transportation Code, is
1-12     amended to read as follows:
1-13           (3)  "Local government" means a municipality [or] county or
1-14     navigation district or port authority created under Article III,
1-15     Section 52 or Article XVI, Section 59, Texas Constitution, or other
1-16     public port authority.
1-17           SECTION 3.  Chapter 62, Water Code, is amended by adding
1-18     Subchapter I, as follows:
1-19           SUBCHAPTER I, PURCHASES; CONTRACTS
1-20     Sec. 62.350.  Purchasing Contracts.  District contracts valued at
1-21     $25,000 or more in the aggregate for each 12-month period may be
1-22     made by any of the methods available to school districts under
 2-1     Chapter 44, Subchapter B, Education Code, that provides the best
 2-2     value to the district.
 2-3           SECTION 4.  The importance of this legislation and the
 2-4     crowded condition of the calendars in both houses create an
 2-5     emergency and an imperative public necessity that the
 2-6     constitutional rule requiring bills to be read on three several
 2-7     days in each house be suspended, and this rule is hereby suspended.
