                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to property dedicated to the State Cemetery.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  Subsection (b), Section 2165.256, Government
 1-4     Code, is amended to read as follows:
 1-5           (b)  In addition to the property described as Lot No. 5,
 1-6     Division B, City of Austin, Travis County, Texas, the following
 1-7     property is dedicated for cemetery purposes as part of the State
 1-8     Cemetery:  BEING 44.07 ACRES OF LAND OUT OF THE GEORGE W. SPEAR
 1-9     LEAGUE IN THE CITY OF AUSTIN, TRAVIS COUNTY, TEXAS, AND BEING OUT
1-10     OF AND A PORTION OF THAT CERTAIN TRACT OF LAND DESCRIBED BY DEED TO
1-11     THE STATE OF TEXAS AS RECORDED IN VOLUME 776, PAGE 225, OF THE DEED
1-12     RECORDS OF TRAVIS COUNTY, TEXAS.  SAID 44.07 ACRES OF LAND BEING
1-13     MORE PARTICULARLY DESCRIBED AS FOLLOWS:
1-14           BEGINNING at a set brass cap in concrete for the northwest
1-15     corner of said State of Texas tract, same being the west corner of
1-16     Lot 34 of Shoal Village, Section Two, a subdivision in the City of
1-17     Austin, Texas, as recorded in Book 5, Page 150, of the Plat Records
1-18     of Travis County, Texas, and being on the east right-of-way line of
1-19     Bull Creek Road (an existing 60' R/W) and being the northwest
1-20     corner of this tract;
1-21                 (1)  THENCE S 62 05' 02" E, along the north line of
1-22     said State of Texas tract of land, same being the south line of
1-23     said subdivision, a distance of 919.08 feet to a set brass cap in
1-24     concrete for an angle point in the north line of said State of
 2-1     Texas, tract of land same being an angle point in the south line of
 2-2     Lot 45 of Shoal Village, Section Three, a subdivision of record in
 2-3     the City of Austin, Texas, as recorded in Book 6, Page 71, of the
 2-4     Plat Records of Travis County, Texas;
 2-5                 (2)  THENCE along the north line of said State of
 2-6     Texas, tract of land, same being the south line of the following
 2-7     subdivisions in the City of Austin, Texas, said Shoal Village,
 2-8     Section Three, Shoal Village, Sec. 5, as recorded in Plat Book 6,
 2-9     Page 72, of the Plat Records of Travis County, Texas, Shoal
2-10     Village, Sec. 6, as recorded in Plat Book 7, Page 7, of the Plat
2-11     Records of Travis County, Texas, Shoal Village, Section Seven, as
2-12     recorded in Plat Book 14, Page 80, of the Plat Records of Travis
2-13     County, Texas, Oak Haven, Section Three, as recorded in Book 11,
2-14     Page 40, of the Plat Records of Travis County, Texas, the following
2-15     two (2) courses and distances:
2-16                       1.  S 63 02' 45" E, a distance of 306.61 feet, a
2-17     1/2" iron rod found, and
2-18                       2.  S 63 11' 57" E, a distance of 327.57 feet to
2-19     the point of intersection with the centerline of Shoal Creek for
2-20     the northeast corner of this tract;
2-21                 (3)  THENCE along the centerline of Shoal Creek with
2-22     it's meanders, same being the east line of this tract, the
2-23     following seven (7) courses and distances:
2-24                       1.  S 03 49' 32" E, a distance of 146.37 feet, a
2-25     1/2" I. R. set,
2-26                       2.  S 11 51' 40" W, a distance of 68.56 feet, a
 3-1     1/2" I. R. set,
 3-2                       3.  S 17 44' 58" E, a distance of 255.55 feet, a
 3-3     1/2" I. R. set,
 3-4                       4.  S 11 22' 50" W, a distance of 433.59 feet, a
 3-5     1/2" I. R. set,
 3-6                       5.  S 01 30' 40" E, a distance of 208.10 feet, a
 3-7     1/2" I. R. set,
 3-8                       6.  S 03 34' 39" E, a distance of 163.82 feet, a
 3-9     1/2" I. R. set, and
3-10                       7.  S 12 53' 44" E, a distance of 44.69 feet, to
3-11     a P. K. nail set in concrete for the southeast corner of this
3-12     tract;
3-13                 (4)  THENCE N 62 12' 25" W, departing from said Shoal
3-14     Creek, passing the northeast corner of Lot 24 of Ridgelea, a
3-15     subdivision in the City of Austin, Texas, as recorded in Book 4,
3-16     Page 258, of the Plat Records of Travis County, Texas, at 59.90
3-17     feet, a total distance of 414.19 feet to a found 1/2" iron rod
3-18     under concrete for the most northerly corner of Lot 21 of said
3-19     Ridgelea subdivision, said point also being a re-entrant corner of
3-20     this tract;
3-21                 5)  THENCE S 31 29' 35" W, along the most southerly
3-22     east line of said State of Texas tract of land, same being the west
3-23     line of said Ridgelea subdivision, a distance of 715.50 feet to a
3-24     1/2" iron rod set for a southwest corner of this tract, from this
3-25     point the northwest corner of Lot 11, same being the southwest
3-26     corner of Lot 12, of said Ridgelea subdivision bears N 31 29' 35"
 4-1     E, a distance of 10.64 feet;
 4-2                 6)  THENCE through said State of Texas tract of land
 4-3     the following four (4) courses and distances:
 4-4                       1.  N 23 52' 33" W, passing a brass cap in
 4-5     concrete set at 5.00 feet, a total distance of 654.65 feet to a
 4-6     brass cap in concrete set for a corner,
 4-7                       2.  N 06 26' 42" E, a distance of 308.11 feet, a
 4-8     brass cap in concrete set for a corner,
 4-9                       3.  N 14 01' 31" W, a distance of 894.05 feet, a
4-10     brass cap in concrete set for a corner, and
4-11                       4.  N 63 17' 00" W, a distance of 478.50 feet to
4-12     a brass cap set in concrete at the point of intersection with the
4-13     east right-of-way line of Bull Creek Road, same being the west line
4-14     of said State of Texas tract of land, and being the most northerly
4-15     southwest corner of this tract;
4-16                 (7)  THENCE N 26 43' 00" E, along said right-of-way
4-17     line, a distance of 496.30 feet to the Point of Beginning, and
4-18     containing 44.07 acres of land, more or less; and
4-19           BEING A 2.120 ACRE (92,350 SQUARE FEET) TRACT OF LAND OUT OF
4-20     THE GEORGE W. SPEAR LEAGUE IN TRAVIS COUNTY, TEXAS.  SAID 2.120
4-21     ACRE TRACT OF LAND ALSO BEING OUT OF A 31.12 ACRE TRACT HAVING BEEN
4-22     CONVEYED TO THE STATE OF TEXAS BY INSTRUMENT OF RECORD IN VOLUME
4-23     776, PAGE 225, DEED RECORDS OF TRAVIS COUNTY, TEXAS.  SAID 2.120
4-24     ACRE TRACT BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
4-25     FOLLOWS:
4-26           BEGINNING, at a brass disk in concrete found on the
 5-1     southeasterly right of way line of Bull Creek Road.  Said disk also
 5-2     being at the northernmost corner of said 31.12 acre tract and the
 5-3     westernmost corner of a 44.07 acre tract also out of the tract
 5-4     described in volume 776, page 225 for the northernmost corner of
 5-5     the herein described tract;
 5-6           Thence, S63 17' 00"E, 350.00 feet with the northeasterly line
 5-7     of said 31.12 acre tract and a southwesterly line of said 44.07
 5-8     acre tract to a 1/2" iron rod set for the easternmost corner of the
 5-9     herein described tract;
5-10           Thence, S26 42' 58"W, 205.49 feet with the southeast line of
5-11     this 2.120 acre tract to a 1/2" iron rod set for the herein
5-12     described tract, nearby a concrete driveway;
5-13           Thence, N82 57' 38"W, 276.95 feet following a concrete
5-14     driveway to a 1/2" iron rod set for an angle point of the herein
5-15     described tract;
5-16           Thence, N62 30' 47"W, 89.24 feet continuing along a concrete
5-17     driveway to a 1/2" iron rod set on the southeasterly right of way
5-18     line of Bull Creek Road and the westernmost corner of the herein
5-19     described tract;
5-20           THENCE, N26 43' 00"E, 297.55 feet with the southeasterly line
5-21     of Bull Creek Road and the northwesterly line of this 2.120 acre
5-22     tract to the POINT OF BEGINNING and containing 2.120 acre (92,350
5-23     square feet) of land.  [BEING APPROXIMATELY 50.00 ACRES OF LAND OUT
5-24     OF AND A PORTION OF THE FOLLOWING DESCRIBED TRACT OF LAND. 75.688
5-25     RECORD ACRES OF LAND OUT OF THE GEORGE W. SPEAR SURVEY IN THE CITY
5-26     OF AUSTIN, TRAVIS COUNTY, TEXAS, DESCRIBED BY DEED TO THE STATE OF
 6-1     TEXAS AS RECORDED IN VOLUME 76, PAGE 225, OF THE DEED RECORDS OF
 6-2     TRAVIS COUNTY, TEXAS, SAID 75.688 ACRE TRACT OF LAND BEING MORE
 6-3     PARTICULARLY DESCRIBED AS FOLLOWS:]
 6-4                 [(1)  bounded on the west by Bull Creek Road;]
 6-5                 [(2)  bounded on the north by the following
 6-6     subdivisions in the City of Austin, Texas:]
 6-7                       [(A)  Shoal Village Section 2, as recorded in
 6-8     Plat Book 5, Page 150, of the Plat Records of Travis County, Texas;]
 6-9                       [(B)  Shoal Village Section 3, as recorded in
6-10     Plat Book 6, Page 71, of the Plat Records of Travis County, Texas;]
6-11                       [(C)  Shoal Village Section 5, as recorded in
6-12     Plat Book 6, Page 72, of the Plat Records of Travis County, Texas;]
6-13                       [(D)  Shoal Village Section 6, as recorded in

6-26           SECTION 2.  This Act takes effect September 1, 1999.
 7-1           SECTION 3.  The importance of this legislation and the
 7-2     crowded condition of the calendars in both houses create an
 7-3     emergency and an imperative public necessity that the
 7-4     constitutional rule requiring bills to be read on three several
 7-5     days in each house be suspended, and this rule is hereby suspended.
