AN ACT
1-1 relating to the leasing of classroom space for an institution of
1-2 higher education.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subsection (b), Section 2167.001, Government
1-5 Code, is amended to read as follows:
1-6 (b) This chapter does not apply to:
1-7 (1) aircraft hangar space;
1-8 (2) radio antenna space;
1-9 (3) boat storage space;
1-10 (4) vehicle parking space;
1-11 (5) residential space for a Texas Department of Mental
1-12 Health and Mental Retardation program;
1-13 (6) residential space for a Texas Youth Commission
1-14 program;
1-15 (7) space to be used for less than one month for
1-16 meetings, conferences, conventions, seminars, displays,
1-17 examinations, auctions, or similar purposes;
1-18 (8) district office space for members of the
1-19 legislature;
1-20 (9) space used by the Texas Employment Commission;
1-21 [or]
1-22 (10) residential property acquired by the Texas
1-23 Department of Housing and Community Affairs or the Texas State
1-24 Affordable Housing Corporation that is offered for sale or rental
2-1 to individuals and families of low or very low income or families
2-2 of moderate income; or
2-3 (11) except as provided by Section 2167.007, classroom
2-4 and instructional space for an institution of higher education.
2-5 SECTION 2. Subchapter A, Chapter 2167, Government Code, is
2-6 amended by adding Section 2167.0051 to read as follows:
2-7 Sec. 2167.0051. CLASSROOM AND INSTRUCTIONAL SPACE. (a) An
2-8 institution of higher education may not lease classroom and
2-9 instructional space unless the portion of the building to be used
2-10 by the institution complies with the applicable standards and
2-11 specifications under the architectural barriers law, Article 9102,
2-12 Revised Statutes.
2-13 (b) An institution of higher education may lease classroom
2-14 and instructional space through competitive bidding in accordance
2-15 with Section 2167.053 or through competitive sealed proposals in
2-16 accordance with Section 2167.054 or may negotiate for that space on
2-17 making a determination that competition is not available and shall
2-18 include provisions to obtain a lease contract for classroom and
2-19 instructional space in accordance with Section 2167.055.
2-20 SECTION 3. The importance of this legislation and the
2-21 crowded condition of the calendars in both houses create an
2-22 emergency and an imperative public necessity that the
2-23 constitutional rule requiring bills to be read on three several
2-24 days in each house be suspended, and this rule is hereby suspended,
2-25 and that this Act take effect and be in force from and after its
2-26 passage, and it is so enacted.
