A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the leasing of classroom space for an institution of
1-3 higher education.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subsection (b), Section 2167.001, Government
1-6 Code, is amended to read as follows:
1-7 (b) This chapter does not apply to:
1-8 (1) aircraft hangar space;
1-9 (2) radio antenna space;
1-10 (3) boat storage space;
1-11 (4) vehicle parking space;
1-12 (5) residential space for a Texas Department of Mental
1-13 Health and Mental Retardation program;
1-14 (6) residential space for a Texas Youth Commission
1-15 program;
1-16 (7) space to be used for less than one month for
1-17 meetings, conferences, conventions, seminars, displays,
1-18 examinations, auctions, or similar purposes;
1-19 (8) district office space for members of the
1-20 legislature;
1-21 (9) space used by the Texas Employment Commission;
1-22 [or]
1-23 (10) residential property acquired by the Texas
1-24 Department of Housing and Community Affairs or the Texas State
2-1 Affordable Housing Corporation that is offered for sale or rental
2-2 to individuals and families of low or very low income or families
2-3 of moderate income; or
2-4 (11) except as provided by Section 2167.007, classroom
2-5 and instructional space for an institution of higher education.
2-6 SECTION 2. Subchapter A, Chapter 2167, Government Code, is
2-7 amended by adding Section 2167.0051 to read as follows:
2-8 Sec. 2167.0051. CLASSROOM AND INSTRUCTIONAL SPACE. (a) An
2-9 institution of higher education may not lease classroom and
2-10 instructional space unless the portion of the building to be used
2-11 by the institution complies with the applicable standards and
2-12 specifications under the architectural barriers law, Article 9102,
2-13 Revised Statutes.
2-14 (b) An institution of higher education must use competitive
2-15 sealed proposals in accordance with Section 2167.054 to lease
2-16 classroom and instructional space and shall include provisions to
2-17 obtain a lease contract for classroom and instructional space in
2-18 accordance with Section 2167.055.
2-19 SECTION 3. The importance of this legislation and the
2-20 crowded condition of the calendars in both houses create an
2-21 emergency and an imperative public necessity that the
2-22 constitutional rule requiring bills to be read on three several
2-23 days in each house be suspended, and this rule is hereby suspended,
2-24 and that this Act take effect and be in force from and after its
2-25 passage, and it is so enacted.
