 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to extracurricular activities sponsored or sanctioned by a
 1-9     school district or the University Interscholastic League.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subdivision (27), Subsection (c), Section 7.102,
1-12     Education Code, is amended to read as follows:
1-13                 (27)  The board shall adopt rules relating to
1-14     extracurricular activities under Section 33.081 and approve or[,]
1-15     disapprove[, or modify] University Interscholastic League rules and
1-16     procedures under Section 33.083.
1-17           SECTION 2.  Subsection (c), Section 33.081, Education Code,
1-18     is amended to read as follows:         
1-19           (c)  A student who is enrolled in a school district in this
1-20     state or who participates in a University Interscholastic League
1-21     competition shall be suspended from participation in any
1-22     extracurricular activity sponsored or sanctioned by the school
1-23     district or the University Interscholastic League after a grade
1-24     evaluation period in which the student received a grade lower than
1-25     the equivalent of 70 on a scale of 100 in any academic class other
1-26     than an identified honors or advanced class.  A suspension
1-27     continues for at least three school weeks and is not removed during
1-28     the school year until the conditions of Subsection (d) are met.  A
1-29     suspension does not last beyond the end of a school year.  For
1-30     purposes of this subsection, "grade evaluation period" means:
1-31                 (1)  the six-week grade reporting period; or
1-32                 (2)  the first six weeks of a semester and each grade
1-33     reporting period thereafter, in the case of a district with a grade
1-34     reporting period longer than six weeks.
1-35           SECTION 3.  Subsection (b), Section 33.083, Education Code,
1-36     is amended to read as follows:
1-37           (b)  The University Interscholastic League is a part of The
1-38     University of Texas at Austin and must submit its rules and
1-39     procedures to the State Board of Education for approval or[,]
1-40     disapproval[, or modification].  The funds belonging to the
1-41     University Interscholastic League shall be deposited with The
1-42     University of Texas at Austin for the benefit of the league and
1-43     shall be subject to audits by The University of Texas at Austin,
1-44     The University of Texas System, and the state auditor.  Copies of
1-45     annual audits shall be furnished, on request, to members of the
1-46     legislature.
1-47           SECTION 4.  This Act takes effect September 1, 1999.
1-48           SECTION 5.  The importance of this legislation and the
1-49     crowded condition of the calendars in both houses create an
1-50     emergency and an imperative public necessity that the
1-51     constitutional rule requiring bills to be read on three several
1-52     days in each house be suspended, and this rule is hereby suspended.
