                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the boundaries of the Port of Port Arthur Navigation
 1-2     District of Jefferson County, Texas.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 1, Chapter 197, Acts of the 58th
 1-5     Legislature, Regular Session, 1963, is amended to read as follows:
 1-6           Sec. 1.  There is hereby created within the State of Texas,
 1-7     in addition to the districts into which the state has heretofore
 1-8     been divided, a port district to be known as the Port of Port
 1-9     Arthur Navigation District of Jefferson County, Texas, situated in
1-10     Jefferson County, Texas, with boundaries as hereinafter set out
1-11     (hereinafter called the district).  Such district shall be and is
1-12     hereby declared to be a governmental agency and body politic and
1-13     corporate with the powers of government and with the authority to
1-14     exercise the rights, privileges and functions hereinafter
1-15     specified, and the creation of such district is hereby determined
1-16     to be essential to the accomplishment of the purposes of Section
1-17     59, of Article 16, of the Constitution of the State of Texas,
1-18     including (to the extent hereinafter authorized) the improvement of
1-19     navigation and the maintenance, development, extension and
1-20     improvement of port facilities, wharf and dock facilities, and the
1-21     development of the Port of Port Arthur within the boundaries
1-22     thereof as hereby established, which is declared to be essential to
1-23     the general welfare of the State of Texas for the development of
1-24     maritime shipping to and from its ports, and in the interest of
 2-1     national defense; the Port of Port Arthur being strategically
 2-2     located on the Gulf Coast with an inland-protected harbor and in a
 2-3     rapidly developing industrial area wherein shipyards and
 2-4     shipstoring basins are located, and the creation of said port
 2-5     district will result in material benefits and improvements to the
 2-6     territory included therein and in the increase of taxable values of
 2-7     property included therein, and result in material benefit to that
 2-8     section of the state in which same is located.
 2-9           The boundaries of said district in Jefferson County, Texas,
2-10     include three tracts of land located in Jefferson County, Texas,
2-11     described [are] as follows:
2-12           (1)  FIRST TRACT BEGINNING at a point of the junction of the
2-13     center line of the rights-of-way of State Highway 87 and the city
2-14     limits line of the City of Port Arthur (as it existed on April 20,
2-15     1963) in the Neches River;
2-16           THENCE following the city limit line of the City of Port
2-17     Arthur (as it existed on April 20, 1963) in the Neches River,
2-18     southward and eastward to a point in the geographic middle of the
2-19     Neches River at its entrance into Sabine Lake;
2-20           THENCE continue to follow southward and eastward, the city
2-21     limit line of the City of Port Arthur, (as it existed on January 1,
2-22     1974) to the point of junction with the geographic middle of Sabine
2-23     Lake;
2-24           THENCE southward and westward along the center line of Sabine
2-25     Lake to a point due east [west] of the junction of the center line
2-26     of the Intracoastal Canal and the center line of the Sabine-Neches
 3-1     Ship Canal;
 3-2           THENCE due west to the center line of the Intracoastal Canal
 3-3     at a point of its junction with the center line of the
 3-4     Sabine-Neches Ship Canal;
 3-5           THENCE westward along the center line of the Intracoastal
 3-6     Canal to its junction with the center line of Jefferson County
 3-7     Drainage District #7 Outfall Canal;
 3-8           THENCE northward along the center line of Jefferson County
 3-9     Drainage District #7 Outfall Canal to its junction with the center
3-10     line of Taylor's Bayou;
3-11           THENCE westward and northward along the center line of
3-12     Taylor's Bayou to its junction with the center line of Rodair
3-13     Gully;
3-14           THENCE eastward along the center line of Rodair Gully to the
3-15     center line of the rights-of-way of the Viterbo [Vitterbo] Road;
3-16           THENCE eastward along the center line of the rights-of-way of
3-17     the Viterbo [Vitterbo] Road to the center line of the rights-of-way
3-18     line of State Highway 69;
3-19           THENCE southward along the center line of the rights-of-way
3-20     of State Highway 69 to the center line of the rights-of-way of FM
3-21     Road No. 365;
3-22           THENCE eastward along the center line of the rights-of-way of
3-23     FM Road No. 365 to the center line of the rights-of-way of State
3-24     Highway 347;
3-25           THENCE southward along the center line of the rights-of-way
3-26     of State Highway 347 to the center line of the rights-of-way of
 4-1     State Highway 73;
 4-2           THENCE [southward and] eastward along the center line of the
 4-3     rights-of-way of State Highway 73 to the center line of the
 4-4     rights-of-way of State Highway 87;
 4-5           THENCE northward and eastward along the center line of the
 4-6     rights-of-way of State Highway 87 to its junction with the city
 4-7     limit line of the City of Port Arthur (as it existed on April 20,
 4-8     1963) in the Neches River, the point of beginning.
 4-9           (2)  SECOND TRACT BEGINNING at a point in the center line of
4-10     the right-of-way of State Highway 87 in Jefferson County, Texas at
4-11     the intersection of the center line of the right-of-way of State
4-12     Highway 87 with a southerly extension of the easterly right-of-way
4-13     line of Pure Atlantic Highway, also referred to as State FM Road
4-14     366;
4-15           THENCE in a Northerly direction along and with the Easterly
4-16     right-of-way line of Pure Atlantic Highway to a point for corner in
4-17     the Southerly right-of-way line of 32nd Street;
4-18           THENCE East along the Southerly right-of-way line of 32nd
4-19     Street to a point for corner at an intersection with a southerly
4-20     extension of the center line of Grandview Avenue;
4-21           THENCE, North 48 deg. 46 min. 14 sec. West along said
4-22     Grandview Avenue for a distance of 1,719.60 feet to a point for
4-23     corner;
4-24           THENCE, North 48 deg. 48 min. 30 sec. West along said

10-13          (3) THIRD TRACT BEGINNING at a point in the geographic middle
10-14    of Sabine Lake due east of the junction of the center line of the
10-15    Intracoastal Canal and the center line of the Sabine-Neches Ship
10-16    Canal;
10-17          THENCE southward and westward along the center line of Sabine
10-18    Lake to its junction with the northeast corner of the Sabine Pass
10-19    Port Authority boundary as it exists as of January 1, 1999;
10-20          THENCE due west along the north boundary line of the Sabine
10-21    Pass Port Authority to its junction with the western bank of the
10-22    Sabine-Neches Ship Canal;
10-23          THENCE northward and westward along the meanders of the
10-24    western bank of the Sabine-Neches Ship Canal to its junction with
10-25    the center line of the Intracoastal Canal.
10-26          SECTION 2.  Proof of publication of the constitutional notice
 11-1    required in the enactment of this Act under the provisions of
 11-2    Section 59(d), Article XVI, Texas Constitution, and the statutory
 11-3    notice required by Chapter 313, Government Code, have been made in
 11-4    the manner provided therein and a copy of the notice and bill as
 11-5    originally introduced have been delivered to the governor of the
 11-6    State of Texas, as required in such constitutional provision, and
 11-7    to all other persons, agencies, officials, or entities required to
 11-8    be furnished by the constitution and other laws of the state, and
 11-9    that notice and delivery are found and declared to be proper and
11-10    sufficient to satisfy those requirements. The Texas Natural
11-11    Resource Conservation Commission has filed its recommendations
11-12    relating to this Act with the governor, lieutenant governor, and
11-13    speaker of the house of representatives within the required time.
11-14    All other procedural requirements for the notice, introduction, and
11-15    passage of this Act have been fulfilled and accomplished.
11-16          SECTION 3.  The importance of this legislation and the
11-17    crowded condition of the calendars in both houses create an
11-18    emergency and an imperative public necessity that the
11-19    constitutional rule requiring bills to be read on three several
11-20    days in each house be suspended, and this rule is hereby suspended,
11-21    and that this Act take effect and be in force from and after its
11-22    passage, and it is so enacted.
