                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the purchase of a motor vehicle under an Interlocal
 1-3     Cooperation Act contract.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 791.025, Government Code, is amended by
 1-6     adding a new Subsection (c) and redesignating existing Subsections
 1-7     (c) and (d) as Subsections (d) and (e) to read as follows:
 1-8           (c)  A local government, including a council of governments,
 1-9     or a state agency that purchases or arranges the purchase of a
1-10     motor vehicle under an interlocal contract on behalf of a
1-11     contracting party is not a broker, converter, distributor,
1-12     franchised or nonfranchised dealer, lease facilitator, lessor,
1-13     manufacturer, or representative as defined by Section 1.03, Texas
1-14     Motor Vehicle Commission Code (Article 4413(36), Vernon's Texas
1-15     Civil Statutes), and is not subject to the licensing requirements
1-16     of Subchapter D, Texas Motor Vehicle Commission Code (Article
1-17     4413(36), Vernon's Texas Civil Statutes).
1-18           (d)  A local government that purchases goods and services
1-19     under this section satisfies the requirement of the local
1-20     government to seek competitive bids for the purchase of the goods
1-21     and services.
1-22           (e) [(d)]  In this section, "council of governments" means a
1-23     regional planning commission created under Chapter 391, Local
1-24     Government Code.
 2-1           SECTION 2.  The importance of this legislation and the
 2-2     crowded condition of the calendars in both houses create an
 2-3     emergency and an imperative public necessity that the
 2-4     constitutional rule requiring bills to be read on three several
 2-5     days in each house be suspended, and this rule is hereby suspended.
