                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to garnishment of an account.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  Chapter 63, Civil Practices and Remedies Code, is
 1-4     amended by adding section 63.007 to read as follows:
 1-5           Section 63.007.  Garnishment of Account
 1-6           In an action in which the garnishee is a bank, savings and
 1-7     loan association, credit union, or securities brokerage firm, the
 1-8     amount of any judgment entered against the garnishee shall not
 1-9     exceed the total value of the assets located in the account,
1-10     together with any amounts added to the account through the date of
1-11     the judgment.
1-12           SECTION 2.  Effective Date.  This act takes effect on
1-13     September 1, 1999.
1-14           SECTION 3.  The importance of this legislation and the
1-15     crowded condition of the calendars in both houses create an
1-16     emergency and an imperative public necessity that the
1-17     constitutional rule requiring bills to be read on three several
1-18     days in each house be suspended, and this rule is hereby suspended,
1-19     and that this Act take effect and be in force from and after its
1-20     passage, and it is so enacted.
