                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of a judicial district composed of
 1-3     Rockwall County.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter C, Chapter 24, Government Code, is
 1-6     amended by adding Section 24.568 to read as follows:
 1-7           Sec. 24.568.  423RD JUDICIAL DISTRICT (ROCKWALL COUNTY).
 1-8     (a)  The 423rd Judicial District is composed of Rockwall County.
 1-9           (b)  The 423rd District Court has concurrent jurisdiction
1-10     with the county court in Rockwall County over all matters of civil
1-11     and criminal jurisdiction, original and appellate, in cases over
1-12     which the county court has jurisdiction under the constitution and
1-13     laws of this state.  Matters and proceedings in the concurrent
1-14     jurisdiction of the 423rd District Court and the county court may
1-15     be filed in either court and all cases of concurrent jurisdiction
1-16     may be transferred between the 423rd District Court and the county
1-17     court.  However, a case may not be transferred from one court to
1-18     another without the consent of the judge of the court to which it
1-19     is transferred, and a case may not be transferred unless it is
1-20     within the jurisdiction of the court to which it is transferred.
1-21           SECTION 2.  The 423rd Judicial District is created and this
1-22     Act takes effect September 1, 1999.
1-23           SECTION 3.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended.
