A BILL TO BE ENTITLED
AN ACT
1-1 relating to the named insured on a workers' compensation policy.
1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-3 SECTION 1. Section 408.001, Labor Code is amended by adding
1-4 the following:
1-5 Sec. 408.001. EXCLUSIVE REMEDY; EXEMPLARY DAMAGES.
1-6 (a) Recovery of workers' compensation benefits is the
1-7 exclusive remedy of an employee covered by workers' compensation
1-8 insurance coverage or a legal beneficiary against the employer, or
1-9 the parent corporation, subsidiary corporation, or subsidiary of
1-10 the parent corporation of the employer, which are named insureds on
1-11 the same policy of workers' compensation insurance as the employer
1-12 or [an] their agents or employees [of the employer] for the death of or
1-13 a work related injury sustained by the employee.
1-14 SECTION 2. This act takes effect on September 1, 1999, and
1-15 applies to a compensable injury that occurs on or after that date.
1-16 SECTION 3. The importance of this legislation and the
1-17 crowded condition of the calendars in both houses create an
1-18 emergency and an imperative public necessity that the
1-19 constitutional rule requiring bills to be read on three several
1-20 days in each house be suspended, and this rule is hereby suspended.
