                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the Houston Downtown Management District.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  ENLARGEMENT OF BOUNDARIES.  (a)  The boundaries
 1-5     of the Houston Downtown Management District created pursuant to
 1-6     Subchapter A, Chapter 376, Local Government Code, are hereby
 1-7     enlarged to include the territory contained in the following
 1-8     described areas:
 1-9           Annexation Area A - 378 acres, more or less, in the J. Austin
1-10     Survey, Abstract 1, the J. S. Holman Survey, Abstract 323, the O.
1-11     Smith Survey, Abstract 696, the S. Harris Survey, Abstract 327, S.
1-12     M. Williams Survey,  Abstract 87 and the J. Wells Survey, Abstract
1-13     832, Harris County, Texas, more particularly described as follows:
1-14     BEGINNING at a point along the Houston Downtown Management District
1-15     boundary at the intersection of the center line of the right-of-way
1-16     of Interstate Highway 45 with the center line of the right-of-way
1-17     of Franklin Avenue,
1-18           Thence in an easterly direction along the Houston Downtown
1-19     Management District boundary and the center line of the
1-20     right-of-way of Franklin Avenue to the intersection with a
1-21     southerly projection of the center line of the northbound ramp to
1-22     Interstate Highway 10, a continuation of Louisiana Street,
1-23           Thence in a northerly direction along the Houston Downtown
1-24     Management District boundary and the center line of the
 2-1     right-of-way of the northbound ramp to Interstate Highway 10 and
 2-2     the southerly projection thereof, to the intersection with the
 2-3     center line of the Southern Pacific Rail Road's "Main Passenger
 2-4     Line" right-of-way,
 2-5           Thence in an easterly direction along the Houston Downtown
 2-6     Management District boundary and the center line of the Southern
 2-7     Pacific Rail Road's "Main Passenger Line" right-of-way to the
 2-8     intersection with the center line of the right-of-way of North San
 2-9     Jacinto Street,
2-10           Thence in a southerly direction along the Houston Downtown
2-11     Management District Boundary and the center line of the
2-12     right-of-way of North San Jacinto Street to the intersection with
2-13     the center line of the right-of-way of Commerce Avenue,
2-14           Thence in a southeasterly direction along the Houston
2-15     Downtown Management District boundary and the center line of the
2-16     right-of-way of Commerce Avenue to the center line of the
2-17     right-of-way of Austin Street,
2-18           Thence in a southwesterly direction along the Houston
2-19     Downtown Management District boundary and the center line of the
2-20     right-of-way of Austin Street to the intersection with the center
2-21     line of the right-of-way of Capitol Avenue,
2-22           Thence in a southeasterly direction along the Houston
2-23     Downtown Management District boundary and the center line of the
2-24     right-of-way of Capitol Avenue to the intersection with the center
2-25     line of the right-of-way of U.S. Highway 59,
2-26           Thence in a north and easterly direction with the center line
2-27     of the right-of-way of U.S. Highway 59 to the intersection with the
 3-1     center line of the right-of-way of Interstate Highway 10,
 3-2           Thence in a southwesterly direction with the center line of
 3-3     the right-of-way of Interstate Highway 10 to the intersection with
 3-4     the center line of the right-of-way of Interstate Highway 45,
 3-5           Thence in a southerly direction with the center line of the
 3-6     right-of-way of Interstate Highway 45 to The Point of Beginning,
 3-7     containing 378 acres, more or less, including, without limitation,
 3-8     all air space above and all subsurface below said property.
 3-9           Annexation Area B - 95 acres, more or less, in the J. Austin
3-10     Survey, Abstract 1, the J. S. Holman Survey, Abstract 323, the O.
3-11     Smith Survey, Abstract 696, and the J. Wells Survey, Abstract 832,
3-12     Harris County, Texas, more particularly described as follows:
3-13           BEGINNING at a point along the southern boundary of the
3-14     Houston Downtown Management District at the intersection of the
3-15     center line of the right-of-way of U.S. Highway 59 with the center
3-16     line of the right-of-way of Clay Avenue,
3-17           Thence in a northwesterly direction along the boundary of the
3-18     Houston Downtown Management District and the center line of the
3-19     right-of-way of Clay Avenue to the intersection with the center
3-20     line of the right-of-way of Caroline Street,
3-21           Thence in a southwesterly direction along the boundary of the
3-22     Houston Downtown Management District and the center line of the
3-23     right-of-way of Caroline Street to the intersection with the center
3-24     line of the right-of-way of Pierce Avenue,
3-25           Thence in a easterly direction with the center line of the
3-26     right-of-way of Pierce Avenue to the intersection with the center
3-27     line of the right-of-way of U.S. Highway 59,
 4-1           Thence in a northeasterly direction with the center line of
 4-2     the right-of-way of U.S. Highway 59 to The Point of Beginning,
 4-3     containing 95 acres, more or less, including, without limitation,
 4-4     all air space above and all subsurface below said property.
 4-5           (b)  The boundaries of the Houston Downtown Management
 4-6     District as enlarged by this Act shall include the territory
 4-7     contained in the following described area:
 4-8           1178 acres, more or less, in the J. Austin Survey, Abstract
 4-9     1, the J. S.  Holman Survey, Abstract 323, the O. Smith Survey,
4-10     Abstract 696, the S. Harris Survey, Abstract 327, the S. M.
4-11     Williams Survey, Abstract 87 and the J. Wells Survey, Abstract 832,
4-12     Harris County, Texas, more particularly described as follows:
4-13           BEGINNING at the intersection of the center line of the
4-14     right-of-way of US Highway 59 with the center line of the
4-15     right-of-way of Capitol Avenue,
4-16           Thence in a southeasterly direction with the center line of
4-17     the right-of-way of Capitol Avenue to the intersection with the
4-18     center line of the right-of-way of Chartres Street,
4-19           Thence in a southwesterly direction with the center line of
4-20     the right-of-way of Chartres Street to the intersection with the
4-21     center line of the right-of-way of Clay Avenue,
4-22           Thence in a northwesterly direction with the center line of
4-23     the right-of-way of Clay Avenue to the intersection with the center
4-24     line of the right-of-way of US Highway 59,
4-25           Thence in a southwesterly direction with the center line of
4-26     the right-of-way of US Highway 59 to the intersection with the
4-27     center line of the right-of-way of Pierce Avenue,
 5-1           Thence in a northwesterly direction with the center line of
 5-2     the right-of-way of Pierce Avenue to the intersection with the
 5-3     center line of the right-of-way of Bagby Street,
 5-4           Thence in a northeasterly direction with the center line of
 5-5     the right-of-way of Bagby Street to the intersection with a
 5-6     southerly projection of the west line of the right-of-way of Heiner
 5-7     Street,
 5-8           Thence in a northerly direction with the west line of the
 5-9     right-of-way of Heiner Street and southerly and northerly
5-10     projections thereof to the intersection with the center line of the
5-11     right-of-way of W. Dallas Street,
5-12           Thence in a westerly direction with the center line of the
5-13     right-of-way of W.  Dallas Street to the intersection with a
5-14     southerly projection of the west line of the right-of-way of Heiner
5-15     Street,
5-16           Thence in a northerly direction with the west line of the
5-17     right-of-way of Heiner Street and southerly and northerly
5-18     projections thereof to the intersection with the center line of the
5-19     right-of-way of Allen Parkway,
5-20           Thence in an easterly direction with the center line of the
5-21     right-of-way of Allen Parkway to the intersection with a southerly
5-22     projection of the center line of the right-of-way of Sabine Street,
5-23           Thence in a northerly direction with a southerly projection
5-24     of the center line of the right-of-way of Sabine Street and then
5-25     with the center line of the right-of-way of Sabine Street to the
5-26     intersection with the north right-of-way line of Memorial Drive,
5-27           Thence in an easterly direction with the north right-of-way
 6-1     line of Memorial Drive to the intersection with the west
 6-2     right-of-way line of Interstate Highway 45,
 6-3           Thence in a northeasterly direction with the west
 6-4     right-of-way line of Interstate Highway 45 to the intersection with
 6-5     the center line of the right-of-way of Franklin Avenue,
 6-6           Thence in an easterly direction with the center line of the
 6-7     right-of-way of Franklin Avenue to the intersection with the center
 6-8     line of the right-of-way of Interstate Highway 45,
 6-9           Thence in a northerly direction with the center line of the
6-10     right-of-way of the Interstate Highway 45 to the intersection with
6-11     the center line of the right-of-way of Interstate Highway 10,
6-12           Thence in an southeasterly direction with the center line of
6-13     Interstate Highway 10 to the intersection with the center line of
6-14     the right-of-way of US Highway 59,
6-15           Thence in a south and westerly direction with the center line
6-16     of the right-of-way of US Highway 59 to The Point of Beginning,
6-17     containing 1178 acres, more or less, including, without limitation,
6-18     all air space above and all subsurface below said property.
6-19           SECTION 2.  FINDINGS RELATED TO ENLARGED BOUNDARIES.  The
6-20     boundaries and field notes of the Houston Downtown Management
6-21     District as enlarged by this Act form a closure.  If a mistake is
6-22     made in the field notes or in copying the field notes in the
6-23     legislative process, the mistake does not in any way affect the:
6-24                 (1)  organization, existence, and validity of the
6-25     Houston Downtown Management District;
6-26                 (2)  right of the Houston Downtown Management District
6-27     to issue any type of bonds or refunding bonds for the purposes for
 7-1     which the Houston Downtown Management District is created or pay
 7-2     the principal of and interest on the bonds;
 7-3                 (3)  right of the Houston Downtown Management District
 7-4     to impose and collect assessments or taxes;
 7-5                 (4)  validity of the enlargement of the Houston
 7-6     Downtown Management District by this Act; or
 7-7                 (5)  legality or operation of the Houston Downtown
 7-8     Management District or its governing body.
 7-9           SECTION 3.  VALIDATION.  The governmental acts and
7-10     proceedings of the Houston Downtown Management District and its
7-11     directors and officers occurring before the effective date of this
7-12     Act are validated as of the dates they occurred.
7-13           SECTION 4.  EMERGENCY.  The importance of this legislation
7-14     and the crowded condition of the calendars in both houses create an
7-15     emergency and an imperative public necessity that the
7-16     constitutional rule requiring bills to be read on three several
7-17     days in each house be suspended, and this rule is hereby suspended.
