 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to an exception to distribution of publications by state
 1-9     agencies.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subchapter C, Chapter 2052, Government Code, is
1-12     amended by adding Section 2052.207 to read as follows:
1-13           Sec. 2052.207.  EXCEPTION TO CERTAIN DISTRIBUTION
1-14     REQUIREMENTS.  Sections 2052.202, 2052.203, and 2052.204 do not
1-15     apply to the distribution of a publication during a calendar year
1-16     by a state agency if the head of the agency:
1-17                 (1)  determined by December 31 of the previous calendar
1-18     year that the publication will be distributed during the year by a
1-19     reasonably accurate mailing list;
1-20                 (2)  determined that it would not be cost-effective to
1-21     recreate the mailing list for a publication under Sections
1-22     2052.202, 2052.203, and 2052.204; and
1-23                 (3)  not later than December 31 of the previous
1-24     calendar year, notified in writing the following persons of each
1-25     publication to which Sections 2052.202, 2052.203, and 2052.204 will
1-26     not apply during the calendar year:
1-27                       (A)  the governor;
1-28                       (B)  the lieutenant governor;
1-29                       (C)  the speaker of the house of representatives;
1-30                       (D)  the comptroller; and
1-31                       (E)  the state auditor.
1-32           SECTION 2.  This Act takes effect September 1, 1999.
