                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the creation, administration, powers, duties,
 1-2     operations, and financing of Horseshoe Bay Water Control and
 1-3     Improvement District No. 1, Horseshoe Bay Water Control and
 1-4     Improvement District No. 2, and Horseshoe Bay Water Control and
 1-5     Improvement District No. 3; granting authority for taxation and
 1-6     bonds and the power of eminent domain.
 1-7           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-8           ARTICLE 1.  HORSESHOE BAY WATER CONTROL AND IMPROVEMENT
 1-9                               DISTRICT NO. 1
1-10           SECTION 1.01.  CREATION.  (a)  A conservation and reclamation
1-11     district, to be known as Horseshoe Bay Water Control and
1-12     Improvement District No. 1, is created in Llano and Burnet
1-13     Counties, subject to approval at a confirmation election under
1-14     Section 1.09 of this article.  The district is a governmental
1-15     agency and a body politic and corporate.
1-16           (b)  The district is created under and is essential to
1-17     accomplish the purposes of Section 59, Article XVI, Texas
1-18     Constitution.
1-19           SECTION 1.02.  DEFINITIONS.  In this article:
1-20                 (1)  "Commission" means the Texas Natural Resource
1-21     Conservation Commission.
1-22                 (2)  "District" means Horseshoe Bay Water Control and
1-23     Improvement District No. 1.
1-24           SECTION 1.03.  BOUNDARIES.  The district includes the
 2-1     territory contained within the following area:
 2-2     BEING 607.97 acres of land comprised of 61.50 acres out of the A.
 2-3     Backus Survey No. 919, Abstract No. 1125 in Llano County; 292.12
 2-4     acres out of the Nicholas Mendez Survey No. 3, Abstract No. 506 in
 2-5     Llano County; 200.10 acres out of the Jno. Darlin Survey No. 4,
 2-6     Abstract No. 170 in Llano County; and 54.25 acres out of the Jno.
 2-7     Darlin Survey No. 4, Abstract No. 248 in Burnet County, Texas; and
 2-8     further being out of that certain 5080.43 acre tract described in
 2-9     Deeds to John F. Thomas, et al as recorded in Vol. 89 at Page 385
2-10     of the DEED RECORDS of Llano County, Texas and at Vol. 119 at Page
2-11     639 of the DEED RECORDS of Burnet County, Texas, said 607.97 acres
2-12     being more particularly described as follows:
2-13     BEGINNING at the most northerly Northwest corner of said 5080.43
2-14     acre tract in the westerly line of said Darlin Survey and the
2-15     easterly line of said Mendez Survey, for the most northerly
2-16     Northwest corner hereof;
2-17     THENCE N 89 30' 43" E at 2022.22 ft., cross the East line of Llano
2-18     County, and the East line of Burnet County, and at 2823.54 ft., in
2-19     all to a 1/2 inch iron pin set, for the Northeast corner hereof and
2-20     the Northwest corner of a 480.40 acre tract out of said 5080.43
2-21     acre tract; THENCE S 4 40' 35" W at 2093.34 ft., pass a 1/2 inch
2-22     iron pin set at a northerly Southwest corner of said 480.40 acre
2-23     tract and the Northwest corner of an 85.40 acre tract out of said
2-24     5080.43 acre tract, and at 3932.12 ft., in all to a 1/2 inch iron
2-25     pin set at the Southwest corner of said 85.40 acre tract in the
2-26     northerly right-of-way line of State Highway No. 71, for the
 3-1     Southeast corner hereof;
 3-2     THENCE along said highway right-of-way line in six (6) courses and
 3-3     distances as follows:
 3-4           1)    along a curve to the left of radius 3665.93 ft.,
 3-5                 central angle 8 43' 49", and along chord bearing S 78
 3-6                 43' 06" W 558.05 ft., a concrete highway monument,
 3-7                 whence a point in the easterly line of Llano County and
 3-8                 the westerly line of Burnet County bears N 75 33' 22" E
 3-9                 154.0 ft., and a 1/2 inch iron pin set in a stone mound
3-10                 found on said County Line bears additionally S 1 11'
3-11                 16" E 879.50 ft.;
3-12           2)    S 74 21' 10" W 3892.06 ft., a concrete highway
3-13                 monument;
3-14           3)    along a curve to right of radius 5638.72 ft., central
3-15                 angle 4 29' 46", and along chord bearing S 76 36' 04" W
3-16                 442.37 ft., a concrete highway monument;
3-17           4)    S 78 50' 58" W 2208.94 ft., a concrete highway
3-18                 monument;
3-19           5)    along a curve to the right of radius 3730.24 ft.,
3-20                 central angle 17 29' 00", and along chord bearing S 87
3-21                 35' 27" W 1133.84 ft., a concrete highway monument; and
3-22           6)    N 83 40' 03" W 3456.10 ft., to a 1/2 inch iron pin
3-23                 found, for the Southwest corner hereof in the westerly
3-24                 line of said 5080.43 acre tract;
3-25     THENCE N 0 24' 22" W 1566.00 FT., TO A SOUTHERLY Northwest corner
3-26     of said 5080.43 acre tract and hereof;
 4-1     THENCE N 88 48' 44" E 9002.00 ft., to a reentrant corner of said
 4-2     5080.43 acre tract and hereof;
 4-3     THENCE N 0 30' 42" W 3497.61 ft., to the Place of BEGINNING hereof
 4-4     and containing 607.97 acres of land.
 4-5           SECTION 1.04.  FINDINGS RELATING TO BOUNDARIES.  The
 4-6     legislature finds that the boundaries and field notes of the
 4-7     district form a closure.  A mistake in the field notes or in
 4-8     copying the field notes in the legislative process does not affect
 4-9     the organization, existence, or validity of the district, the right
4-10     of the district to levy and collect taxes, or the legality or
4-11     operation of the district or its governing body.
4-12           SECTION 1.05.  FINDING OF BENEFIT.  All of the land and other
4-13     property included within the boundaries of the district will be
4-14     benefited by the works and projects that are to be accomplished by
4-15     the district under the powers conferred by Section 59, Article XVI,
4-16     Texas Constitution.  The district is created to serve a public use
4-17     and benefit.
4-18           SECTION 1.06.  POWERS.  (a)  The district has all of the
4-19     rights, powers, privileges, authority, functions, and duties
4-20     provided by the general law of this state, including Chapters 49
4-21     and 51, Water Code, applicable to water control and improvement
4-22     districts created under Section 59, Article XVI, Texas
4-23     Constitution.  This article prevails over any provision of general
4-24     law that is in conflict or inconsistent with this article.
4-25           (b)  The rights, powers, privileges, authority, functions,
4-26     and duties of the district are subject to the continuing right of
 5-1     supervision of the state to be exercised by and through the
 5-2     commission.
 5-3           SECTION 1.07.  BOARD OF DIRECTORS.  (a)  The district is
 5-4     governed by a board of five directors.
 5-5           (b)  Temporary directors serve until initial permanent
 5-6     directors are elected under Section 1.09 of this article.
 5-7           (c)  Initial permanent directors serve until permanent
 5-8     directors are elected under Section 1.10 of this article.
 5-9           (d)  Permanent directors other than initial permanent
5-10     directors serve staggered four-year terms.
5-11           (e)  Each director must qualify to serve as director in the
5-12     manner provided by Section 49.055, Water Code.
5-13           (f)  A director serves until the director's successor has
5-14     qualified.
5-15           SECTION 1.08.  TEMPORARY DIRECTORS.  (a)  The temporary board
5-16     of directors is composed of:
5-17                 (1)  Shelton Thibodeaux;
5-18                 (2)  Charlie Tenbush;
5-19                 (3)  Dick Tips;
5-20                 (4)  Michael Mallick; and
5-21                 (5)  Doug Willoughby.
5-22           (b)  If a temporary director fails to qualify for office, the
5-23     temporary directors who have qualified shall appoint a person to
5-24     fill the vacancy.  If at any time there are fewer than three
5-25     qualified temporary directors, the commission shall appoint the
5-26     necessary number of persons to fill all vacancies on the board.
 6-1           SECTION 1.09.  CONFIRMATION AND INITIAL DIRECTORS' ELECTION.
 6-2     The temporary board of directors shall call and hold an election to
 6-3     confirm establishment of the district and to elect five initial
 6-4     directors as provided by Chapter 49, Water Code.
 6-5           SECTION 1.10.  ELECTION OF DIRECTORS.  On the first Saturday
 6-6     in May of the fourth year after the year in which the confirmation
 6-7     election is held, an election shall be held in the district for the
 6-8     election of two directors who shall serve two-year terms and three
 6-9     directors who shall serve four-year terms.  Thereafter, on the same
6-10     date in each subsequent second year, the appropriate number of
6-11     directors shall be elected to the board.
6-12           SECTION 1.11.  PROHIBITION AGAINST IMPAIRMENT OF DISTRICT.  A
6-13     municipality in whose extraterritorial jurisdiction the district is
6-14     located may not adopt an ordinance or resolution or take any other
6-15     action that:
6-16                 (1)  impairs the ability of the district to exercise
6-17     its powers under this article; or
6-18                 (2)  limits the ability of the district to finance,
6-19     construct, or operate its water, wastewater, or drainage systems.
6-20           SECTION 1.12.  ANNEXATION.  (a)  The district may be annexed
6-21     by a municipality on the earlier of:
6-22                 (1)  the date of installation of 90 percent of all
6-23     works, improvements, facilities, plants, equipment, and appliances
6-24     necessary and adequate to:
6-25                       (A)  provide service to the proposed development
6-26     within the district;
 7-1                       (B)  accomplish the purposes for which the
 7-2     district was created; and
 7-3                       (C)  exercise the powers provided by the general
 7-4     law of this state and this article; or
 7-5                 (2)  the 20th anniversary of the date the district is
 7-6     confirmed.
 7-7           (b)  The district may add or exclude land or divide into two
 7-8     or more districts, in the manner provided by Chapters 49 and 51,
 7-9     Water Code, without the consent of any municipality.
7-10           SECTION 1.13.  REIMBURSEMENT TO LANDOWNER OR DEVELOPER;
7-11     INSTALLATION OF FACILITIES.  If a municipality in whose
7-12     extraterritorial jurisdiction the district is located annexes the
7-13     district for full or limited purposes and the annexation precludes
7-14     or impairs the ability of the district to issue bonds, the
7-15     municipality shall:
7-16                 (1)  simultaneously with the annexation, pay in cash to
7-17     the landowner or developer of the district a sum equal to all
7-18     actual costs and expenses incurred by the landowner or developer in
7-19     connection with the district that the district has, in writing,
7-20     agreed to pay and that would otherwise have been eligible for
7-21     reimbursement from bond proceeds under the rules and requirements
7-22     of the commission as such rules and requirements exist on the date
7-23     of annexation; and
7-24                 (2)  after the annexation, install all necessary water,
7-25     wastewater, and drainage facilities to serve full buildout of
7-26     development within the district.
 8-1           ARTICLE 2.  HORSESHOE BAY WATER CONTROL AND IMPROVEMENT
 8-2                               DISTRICT NO. 2
 8-3           SECTION 2.01.  CREATION.  (a)  A conservation and reclamation
 8-4     district, to be known as Horseshoe Bay Water Control and
 8-5     Improvement District No. 2, is created in Llano County, subject to
 8-6     approval at a confirmation election under Section 2.09 of this
 8-7     article.  The district is a governmental agency and a body politic
 8-8     and corporate.
 8-9           (b)  The district is created under and is essential to
8-10     accomplish the purposes of Section 59, Article XVI, Texas
8-11     Constitution.

8-18     territory contained within the following area:
8-19     Field notes of 755.794 acres of land (756.169 acres) out of the
8-20     Madison Putman Survey No. 672, Abstract No. 587, the A. Murchison
8-21     Survey No. 85, Abstract No. 556, the J. McFarland Survey No. 1005,
8-22     Abstract No. 555 and the Nicholas Mendez Survey No. 3, Abstract No.
8-23     506 of Llano County, Texas, and consisting of all of those certain
8-24     548.638 acres conveyed to Norman C. Hurd, Trustee # 1, recorded in
8-25     Volume 385, Page 176, 0.372 acre conveyed to Norman C. Hurd,
8-26     Trustee # 1, recorded in Volume 385, Page 173, 11.036 acres
 9-1     conveyed to Norman C. Hurd, Trustee # 1, recorded in Volume 408,
 9-2     Page 7, 183.898 acres conveyed to Norman C. Hurd, Trustee # 1,
 9-3     recorded in Volume 384, Page 148, 12.085 acres conveyed to Norman

17-26          SECTION 2.04.  FINDINGS RELATING TO BOUNDARIES.  The
 18-1    legislature finds that the boundaries and field notes of the
 18-2    district form a closure.  A mistake in the field notes or in
 18-3    copying the field notes in the legislative process does not affect
 18-4    the organization, existence, or validity of the district, the right
 18-5    of the district to levy and collect taxes, or the legality or
 18-6    operation of the district or its governing body.
 18-7          SECTION 2.05.  FINDING OF BENEFIT.  All of the land and other
 18-8    property included within the boundaries of the district will be
 18-9    benefited by the works and projects that are to be accomplished by
18-10    the district under the powers conferred by Section 59, Article XVI,
18-11    Texas Constitution.  The district is created to serve a public use
18-12    and benefit.
18-13          SECTION 2.06.  POWERS.  (a)  The district has all of the
18-14    rights, powers, privileges, authority, functions, and duties
18-15    provided by the general law of this state, including Chapters 49
18-16    and 51, Water Code, applicable to water control and improvement
18-17    districts created under Section 59, Article XVI, Texas
18-18    Constitution.  This article prevails over any provision of general
18-19    law that is in conflict or inconsistent with this article.
18-20          (b)  The rights, powers, privileges, authority, functions,
18-21    and duties of the district are subject to the continuing right of
18-22    supervision of the state to be exercised by and through the
18-23    commission.
18-24          SECTION 2.07.  BOARD OF DIRECTORS.  (a)  The district is
18-25    governed by a board of five directors.
18-26          (b)  Temporary directors serve until initial permanent
 19-1    directors are elected under Section 2.09 of this article.
 19-2          (c)  Initial permanent directors serve until permanent
 19-3    directors are elected under Section 2.10 of this article.
 19-4          (d)  Permanent directors other than initial permanent
 19-5    directors serve staggered four-year terms.
 19-6          (e)  Each director must qualify to serve as director in the
 19-7    manner provided by Section 49.055, Water Code.
 19-8          (f)  A director serves until the director's successor has
 19-9    qualified.
19-10          SECTION 2.08.  TEMPORARY DIRECTORS.  (a)  The temporary board
19-11    of directors is composed of:
19-12                (1)  Glena Yates;
19-13                (2)  Steve Bartholomew;
19-14                (3)  Mike Smith;
19-15                (4)  Val White; and
19-16                (5)  Sandy Senter.
19-17          (b)  If a temporary director fails to qualify for office, the
19-18    temporary directors who have qualified shall appoint a person to
19-19    fill the vacancy.  If at any time there are fewer than three
19-20    qualified temporary directors, the commission shall appoint the
19-21    necessary number of persons to fill all vacancies on the board.
19-22          SECTION 2.09.  CONFIRMATION AND INITIAL DIRECTORS' ELECTION.
19-23    The temporary board of directors shall call and hold an election to
19-24    confirm establishment of the district and to elect five initial
19-25    directors as provided by Chapter 49, Water Code.
19-26          SECTION 2.10.  ELECTION OF DIRECTORS.  On the first Saturday
 20-1    in May of the fourth year after the year in which the confirmation
 20-2    election is held, an election shall be held in the district for the
 20-3    election of two directors who shall serve two-year terms and three
 20-4    directors who shall serve four-year terms.  Thereafter, on the same
 20-5    date in each subsequent second year, the appropriate number of
 20-6    directors shall be elected to the board.
 20-7          SECTION 2.11.  PROHIBITION AGAINST IMPAIRMENT OF DISTRICT.  A
 20-8    municipality in whose extraterritorial jurisdiction the district is
 20-9    located may not adopt an ordinance or resolution or take any other
20-10    action that:
20-11                (1)  impairs the ability of the district to exercise
20-12    its powers under this article; or
20-13                (2)  limits the ability of the district to finance,
20-14    construct, or operate its water, wastewater, or drainage systems.
20-15          SECTION 2.12.  ANNEXATION.  (a)  The district may be annexed
20-16    by a municipality on the earlier of:
20-17                (1)  the date of installation of 90 percent of all
20-18    works, improvements, facilities, plants, equipment, and appliances
20-19    necessary and adequate to:
20-20                      (A)  provide service to the proposed development
20-21    within the district;
20-22                      (B)  accomplish the purposes for which the
20-23    district was created; and
20-24                      (C)  exercise the powers provided by the general
20-25    law of this state and this article; or
20-26                (2)  the 20th anniversary of the date the district is
 21-1    confirmed.
 21-2          (b)  The district may add or exclude land or divide into two
 21-3    or more districts, in the manner provided by Chapters 49 and 51,
 21-4    Water Code, without the consent of any municipality.
 21-5          SECTION 2.13.  REIMBURSEMENT TO LANDOWNER OR DEVELOPER;
 21-6    INSTALLATION OF FACILITIES.  If a municipality in whose
 21-7    extraterritorial jurisdiction the district is located annexes the
 21-8    district for full or limited purposes and the annexation precludes
 21-9    or impairs the ability of the district to issue bonds, the
21-10    municipality shall:
21-11                (1)  simultaneously with the annexation, pay in cash to
21-12    the landowner or developer of the district a sum equal to all
21-13    actual costs and expenses incurred by the landowner or developer in
21-14    connection with the district that the district has, in writing,
21-15    agreed to pay and that would otherwise have been eligible for
21-16    reimbursement from bond proceeds under the rules and requirements
21-17    of the commission as such rules and requirements exist on the date
21-18    of annexation; and
21-19                (2)  after the annexation, install all necessary water,
21-20    wastewater, and drainage facilities to serve full buildout of
21-21    development within the district.
21-22          ARTICLE 3.  HORSESHOE BAY WATER CONTROL AND IMPROVEMENT
21-23                              DISTRICT NO. 3
21-24          SECTION 3.01.  CREATION.  (a)  A conservation and reclamation
21-25    district, to be known as Horseshoe Bay Water Control and
21-26    Improvement District No. 3, is created in Llano County, subject to
 22-1    approval at a confirmation election under Section 3.09 of this
 22-2    article.  The district is a governmental agency and a body politic
 22-3    and corporate.
 22-4          (b)  The district is created under and is essential to
 22-5    accomplish the purposes of Section 59, Article XVI, Texas
 22-6    Constitution.
 22-7          SECTION 3.02.  DEFINITIONS.  In this article:
 22-8                (1)  "Commission" means the Texas Natural Resource
 22-9    Conservation Commission.
22-10                (2)  "District" means Horseshoe Bay Water Control and
22-11    Improvement District No. 3.
22-12          SECTION 3.03.  BOUNDARIES.  The district includes the
22-13    territory contained within the following area:
22-14    A 549.969 acre tract of land out of the Levi Mercer Survey No. 2
22-15    consisting of all of that certain 27.002 acre tract of land
22-16    conveyed by James E. Bauerle et. ux. to Sidney S. McClendon III,
22-17    Trustee, described in a Warranty Deed recorded June 6, 1977 in
22-18    Volume 220, Pages 326-332 of the Llano County Deed Records, a
22-19    portion of that certain 14.93 acre tract of land described as
22-20    Exhibit "C", a portion of that certain 765.315 acre tract of land
22-21    described as Exhibit "A" and all of that certain Tract Two of
22-22    192.117 acres in a Warranty Deed from Buena Vista Corporation to
22-23    Sidney McClendon III, dated August 1, 1977 and recorded in Volume
22-24    220, Pages 750-760 of the Llano County Deed Records, Llano County,
22-25    Texas, being the same called 549.972 acre tract conveyed to Morris
22-26    D. Jaffe, Jr. by Special Warranty Deed with Vendor's Lien, dated

60-17          SECTION 3.04.  FINDINGS RELATING TO BOUNDARIES.  The
60-18    legislature finds that the boundaries and field notes of the
60-19    district form a closure.  A mistake in the field notes or in
60-20    copying the field notes in the legislative process does not affect
60-21    the organization, existence, or validity of the district, the right
60-22    of the district to levy and collect taxes, or the legality or
60-23    operation of the district or its governing body.
60-24          SECTION 3.05.  FINDING OF BENEFIT.  All of the land and other
60-25    property included within the boundaries of the district will be
60-26    benefited by the works and projects that are to be accomplished by
 61-1    the district under the powers conferred by Section 59, Article XVI,
 61-2    Texas Constitution.  The district is created to serve a public use
 61-3    and benefit.
 61-4          SECTION 3.06.  POWERS.  (a)  The district has all of the
 61-5    rights, powers, privileges, authority, functions, and duties
 61-6    provided by the general law of this state, including Chapters 49
 61-7    and 51, Water Code, applicable to water control and improvement
 61-8    districts created under Section 59, Article XVI, Texas
 61-9    Constitution.  This article prevails over any provision of general
61-10    law that is in conflict or inconsistent with this article.
61-11          (b)  The rights, powers, privileges, authority, functions,
61-12    and duties of the district are subject to the continuing right of
61-13    supervision of the state to be exercised by and through the
61-14    commission.
61-15          SECTION 3.07.  BOARD OF DIRECTORS.  (a)  The district is
61-16    governed by a board of five directors.
61-17          (b)  Temporary directors serve until initial permanent
61-18    directors are elected under Section 3.09 of this article.
61-19          (c)  Initial permanent directors serve until permanent
61-20    directors are elected under Section 3.10 of this article.
61-21          (d)  Permanent directors other than initial permanent
61-22    directors serve staggered four-year terms.
61-23          (e)  Each director must qualify to serve as director in the
61-24    manner provided by Section 49.055, Water Code.
61-25          (f)  A director serves until the director's successor has
61-26    qualified.
 62-1          SECTION 3.08.  TEMPORARY DIRECTORS.  (a)  The temporary board
 62-2    of directors is composed of:
 62-3                (1)  Mindy Rowe;
 62-4                (2)  Leon Stewart;
 62-5                (3)  Jennie Thibodeaux;
 62-6                (4)  Dave Cleary; and
 62-7                (5)  Gary Turner.
 62-8          (b)  If a temporary director fails to qualify for office, the
 62-9    temporary directors who have qualified shall appoint a person to
62-10    fill the vacancy.  If at any time there are fewer than three
62-11    qualified temporary directors, the commission shall appoint the
62-12    necessary number of persons to fill all vacancies on the board.
62-13          SECTION 3.09.  CONFIRMATION AND INITIAL DIRECTORS' ELECTION.
62-14    The temporary board of directors shall call and hold an election to
62-15    confirm establishment of the district and to elect five initial
62-16    directors as provided by Chapter 49, Water Code.
62-17          SECTION 3.10.  ELECTION OF DIRECTORS.  On the first Saturday
62-18    in May of the fourth year after the year in which the confirmation
62-19    election is held, an election shall be held in the district for the
62-20    election of two directors who shall serve two-year terms and three
62-21    directors who shall serve four-year terms.  Thereafter, on the same
62-22    date in each subsequent second year, the appropriate number of
62-23    directors shall be elected to the board.
62-24          SECTION 3.11.  PROHIBITION AGAINST IMPAIRMENT OF DISTRICT.  A
62-25    municipality in whose extraterritorial jurisdiction the district is
62-26    located may not adopt an ordinance or resolution or take any other
 63-1    action that:
 63-2                (1)  impairs the ability of the district to exercise
 63-3    its powers under this article; or
 63-4                (2)  limits the ability of the district to finance,
 63-5    construct, or operate its water, wastewater, or drainage systems.
 63-6          SECTION 3.12.  ANNEXATION.  (a)  The district may be annexed
 63-7    by a municipality on the earlier of:
 63-8                (1)  the date of installation of 90 percent of all
 63-9    works, improvements, facilities, plants, equipment, and appliances
63-10    necessary and adequate to:
63-11                      (A)  provide service to the proposed development
63-12    within the district;
63-13                      (B)  accomplish the purposes for which the
63-14    district was created; and
63-15                      (C)  exercise the powers provided by the general
63-16    law of this state and this article; or
63-17                (2)  the 20th anniversary of the date the district is
63-18    confirmed.
63-19          (b)  The district may add or exclude land or divide into two
63-20    or more districts, in the manner provided by Chapters 49 and 51,
63-21    Water Code, without the consent of any municipality.
63-22          SECTION 3.13.  REIMBURSEMENT TO LANDOWNER OR DEVELOPER;
63-23    INSTALLATION OF FACILITIES.  If a municipality in whose
63-24    extraterritorial jurisdiction the district is located annexes the
63-25    district for full or limited purposes and the annexation precludes
63-26    or impairs the ability of the district to issue bonds, the
 64-1    municipality shall:
 64-2                (1)  simultaneously with the annexation, pay in cash to
 64-3    the landowner or developer of the district a sum equal to all
 64-4    actual costs and expenses incurred by the landowner or developer in
 64-5    connection with the district that the district has, in writing,
 64-6    agreed to pay and that would otherwise have been eligible for
 64-7    reimbursement from bond proceeds under the rules and requirements
 64-8    of the commission as such rules and requirements exist on the date
 64-9    of annexation; and
64-10                (2)  after the annexation, install all necessary water,
64-11    wastewater, and drainage facilities to serve full buildout of
64-12    development within the district.
64-13                     ARTICLE 4.  FINDINGS RELATING TO
64-14                    PROCEDURAL REQUIREMENTS; EMERGENCY
64-15          SECTION 4.01.  FINDINGS RELATING TO PROCEDURAL REQUIREMENTS.
64-16    (a)  The proper and legal notice of the intention to introduce this
64-17    Act, setting forth the general substance of this Act, has been
64-18    published as provided by law, and the notice and a copy of this Act
64-19    have been furnished to all persons, agencies, officials, or
64-20    entities to which they are required to be furnished by the
64-21    constitution and other laws of this state, including the governor,
64-22    who has submitted the notice and Act to the Texas Natural Resource
64-23    Conservation Commission.
64-24          (b)  The Texas Natural Resource Conservation Commission has
64-25    filed its recommendations relating to this Act with the governor,
64-26    lieutenant governor, and speaker of the house of representatives
 65-1    within the required time.
 65-2          (c)  All requirements of the constitution and laws of this
 65-3    state and the rules and procedures of the legislature with respect
 65-4    to the notice, introduction, and passage of this Act are fulfilled
 65-5    and accomplished.
 65-6          SECTION 4.02.  EMERGENCY.  The importance of this legislation
 65-7    and the crowded condition of the calendars in both houses create an
 65-8    emergency and an imperative public necessity that the
 65-9    constitutional rule requiring bills to be read on three several
65-10    days in each house be suspended, and this rule is hereby suspended,
65-11    and that this Act take effect and be in force from and after its
65-12    passage, and it is so enacted.
