 1-7                                   AN ACT
 1-8     relating to the creation, administration, powers, duties,
 1-9     operations, and financing of Horseshoe Bay Water Control and
1-10     Improvement District No. 1, Horseshoe Bay Water Control and
1-11     Improvement District No. 2, and Horseshoe Bay Water Control and
1-12     Improvement District No. 3; granting authority for taxation and
1-13     bonds and the power of eminent domain.
1-14           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-15           ARTICLE 1.  HORSESHOE BAY WATER CONTROL AND IMPROVEMENT
1-16                               DISTRICT NO. 1
1-17           SECTION 1.01.  CREATION.  (a)  A conservation and reclamation
1-18     district, to be known as Horseshoe Bay Water Control and
1-19     Improvement District No. 1, is created in Llano and Burnet
1-20     Counties, subject to approval at a confirmation election under
1-21     Section 1.09 of this article.  The district is a governmental
1-22     agency and a body politic and corporate.
1-23           (b)  The district is created under and is essential to
1-24     accomplish the purposes of Section 59, Article XVI, Texas
1-25     Constitution.
1-26           SECTION 1.02.  DEFINITIONS.  In this article:
1-27                 (1)  "Commission" means the Texas Natural Resource
1-28     Conservation Commission.
1-29                 (2)  "District" means Horseshoe Bay Water Control and
1-30     Improvement District No. 1.
1-31           SECTION 1.03.  BOUNDARIES.  The district includes the
1-32     territory contained within the following area:
1-33     BEING 607.97 acres of land comprised of 61.50 acres out of the A.
1-34     Backus Survey No. 919, Abstract No. 1125 in Llano County; 292.12
1-35     acres out of the Nicholas Mendez Survey No. 3, Abstract No. 506 in
1-36     Llano County; 200.10 acres out of the Jno. Darlin Survey No. 4,
1-37     Abstract No. 170 in Llano County; and 54.25 acres out of the Jno.
1-38     Darlin Survey No. 4, Abstract No. 248 in Burnet County, Texas; and
1-39     further being out of that certain 5080.43 acre tract described in
1-40     Deeds to John F. Thomas, et al as recorded in Vol. 89 at Page 385
1-41     of the DEED RECORDS of Llano County, Texas and at Vol. 119 at Page
1-42     639 of the DEED RECORDS of Burnet County, Texas, said 607.97 acres
1-43     being more particularly described as follows:
1-44     BEGINNING at the most northerly Northwest corner of said 5080.43
1-45     acre tract in the westerly line of said Darlin Survey and the
1-46     easterly line of said Mendez Survey, for the most northerly
1-47     Northwest corner hereof;
1-48     THENCE N 89 30' 43" E at 2022.22 ft., cross the East line of Llano
1-49     County, and the East line of Burnet County, and at 2823.54 ft., in
1-50     all to a 1/2 inch iron pin set, for the Northeast corner hereof and
1-51     the Northwest corner of a 480.40 acre tract out of said 5080.43
1-52     acre tract; THENCE S 4 40' 35" W at 2093.34 ft., pass a 1/2 inch
1-53     iron pin set at a northerly Southwest corner of said 480.40 acre
1-54     tract and the Northwest corner of an 85.40 acre tract out of said
1-55     5080.43 acre tract, and at 3932.12 ft., in all to a 1/2 inch iron
1-56     pin set at the Southwest corner of said 85.40 acre tract in the
1-57     northerly right-of-way line of State Highway No. 71, for the
1-58     Southeast corner hereof;
1-59     THENCE along said highway right-of-way line in six (6) courses and
1-60     distances as follows:
1-61           1)    along a curve to the left of radius 3665.93 ft.,
1-62                 central angle 8 43' 49", and along chord bearing S 78
1-63                 43' 06" W 558.05 ft., a concrete highway monument,
1-64                 whence a point in the easterly line of Llano County and
 2-1                 the westerly line of Burnet County bears N 75 33' 22" E
 2-2                 154.0 ft., and a 1/2 inch iron pin set in a stone mound
 2-3                 found on said County Line bears additionally S 1 11'
 2-4                 16" E 879.50 ft.;
 2-5           2)    S 74 21' 10" W 3892.06 ft., a concrete highway
 2-6                 monument;
 2-7           3)    along a curve to right of radius 5638.72 ft., central
 2-8                 angle 4 29' 46", and along chord bearing S 76 36' 04" W
 2-9                 442.37 ft., a concrete highway monument;
2-10           4)    S 78 50' 58" W 2208.94 ft., a concrete highway
2-11                 monument;
2-12           5)    along a curve to the right of radius 3730.24 ft.,
2-13                 central angle 17 29' 00", and along chord bearing S 87
2-14                 35' 27" W 1133.84 ft., a concrete highway monument; and
2-15           6)    N 83 40' 03" W 3456.10 ft., to a 1/2 inch iron pin
2-16                 found, for the Southwest corner hereof in the westerly
2-17                 line of said 5080.43 acre tract;
2-18     THENCE N 0 24' 22" W 1566.00 FT., TO A SOUTHERLY Northwest corner
2-19     of said 5080.43 acre tract and hereof;
2-20     THENCE N 88 48' 44" E 9002.00 ft., to a reentrant corner of said
2-21     5080.43 acre tract and hereof;
2-22     THENCE N 0 30' 42" W 3497.61 ft., to the Place of BEGINNING hereof
2-23     and containing 607.97 acres of land.
2-24           SECTION 1.04.  FINDINGS RELATING TO BOUNDARIES.  The
2-25     legislature finds that the boundaries and field notes of the
2-26     district form a closure.  A mistake in the field notes or in
2-27     copying the field notes in the legislative process does not affect
2-28     the organization, existence, or validity of the district, the right
2-29     of the district to levy and collect taxes, or the legality or
2-30     operation of the district or its governing body.
2-31           SECTION 1.05.  FINDING OF BENEFIT.  All of the land and other
2-32     property included within the boundaries of the district will be
2-33     benefited by the works and projects that are to be accomplished by
2-34     the district under the powers conferred by Section 59, Article XVI,
2-35     Texas Constitution.  The district is created to serve a public use
2-36     and benefit.
2-37           SECTION 1.06.  POWERS.  (a)  The district has all of the
2-38     rights, powers, privileges, authority, functions, and duties
2-39     provided by the general law of this state, including Chapters 49
2-40     and 51, Water Code, applicable to water control and improvement
2-41     districts created under Section 59, Article XVI, Texas
2-42     Constitution.  This article prevails over any provision of general
2-43     law that is in conflict or inconsistent with this article.
2-44           (b)  The rights, powers, privileges, authority, functions,
2-45     and duties of the district are subject to the continuing right of
2-46     supervision of the state to be exercised by and through the
2-47     commission.
2-48           SECTION 1.07.  BOARD OF DIRECTORS.  (a)  The district is
2-49     governed by a board of five directors.
2-50           (b)  Temporary directors serve until initial permanent
2-51     directors are elected under Section 1.09 of this article.
2-52           (c)  Initial permanent directors serve until permanent
2-53     directors are elected under Section 1.10 of this article.
2-54           (d)  Permanent directors other than initial permanent
2-55     directors serve staggered four-year terms.
2-56           (e)  Each director must qualify to serve as director in the
2-57     manner provided by Section 49.055, Water Code.
2-58           (f)  A director serves until the director's successor has
2-59     qualified.
2-60           SECTION 1.08.  TEMPORARY DIRECTORS.  (a)  The temporary board
2-61     of directors is composed of:
2-62                 (1)  Shelton Thibodeaux;
2-63                 (2)  Charlie Tenbush;
2-64                 (3)  Dick Tips;
2-65                 (4)  Michael Mallick; and
2-66                 (5)  Doug Willoughby.
2-67           (b)  If a temporary director fails to qualify for office, the
2-68     temporary directors who have qualified shall appoint a person to
2-69     fill the vacancy.  If at any time there are fewer than three
 3-1     qualified temporary directors, the commission shall appoint the
 3-2     necessary number of persons to fill all vacancies on the board.
 3-3           SECTION 1.09.  CONFIRMATION AND INITIAL DIRECTORS' ELECTION.
 3-4     The temporary board of directors shall call and hold an election to
 3-5     confirm establishment of the district and to elect five initial
 3-6     directors as provided by Chapter 49, Water Code.
 3-7           SECTION 1.10.  ELECTION OF DIRECTORS.  On the first Saturday
 3-8     in May of the fourth year after the year in which the confirmation
 3-9     election is held, an election shall be held in the district for the
3-10     election of two directors who shall serve two-year terms and three
3-11     directors who shall serve four-year terms.  Thereafter, on the same
3-12     date in each subsequent second year, the appropriate number of
3-13     directors shall be elected to the board.
3-14           SECTION 1.11.  PROHIBITION AGAINST IMPAIRMENT OF DISTRICT.  A
3-15     municipality in whose extraterritorial jurisdiction the district is
3-16     located may not adopt an ordinance or resolution or take any other
3-17     action that:
3-18                 (1)  impairs the ability of the district to exercise
3-19     its powers under this article; or
3-20                 (2)  limits the ability of the district to finance,
3-21     construct, or operate its water, wastewater, or drainage systems.
3-22           SECTION 1.12.  ANNEXATION.  (a)  The district may be annexed
3-23     by a municipality on the earlier of:
3-24                 (1)  the date of installation of 90 percent of all
3-25     works, improvements, facilities, plants, equipment, and appliances
3-26     necessary and adequate to:
3-27                       (A)  provide service to the proposed development
3-28     within the district;
3-29                       (B)  accomplish the purposes for which the
3-30     district was created; and
3-31                       (C)  exercise the powers provided by the general
3-32     law of this state and this article; or
3-33                 (2)  the 20th anniversary of the date the district is
3-34     confirmed.
3-35           (b)  The district may add or exclude land or divide into two
3-36     or more districts, in the manner provided by Chapters 49 and 51,
3-37     Water Code, without the consent of any municipality.
3-38           SECTION 1.13.  REIMBURSEMENT TO LANDOWNER OR DEVELOPER;
3-39     INSTALLATION OF FACILITIES.  If a municipality in whose
3-40     extraterritorial jurisdiction the district is located annexes the
3-41     district for full or limited purposes and the annexation precludes
3-42     or impairs the ability of the district to issue bonds, the
3-43     municipality shall:
3-44                 (1)  simultaneously with the annexation, pay in cash to
3-45     the landowner or developer of the district a sum equal to all
3-46     actual costs and expenses incurred by the landowner or developer in
3-47     connection with the district that the district has, in writing,
3-48     agreed to pay and that would otherwise have been eligible for
3-49     reimbursement from bond proceeds under the rules and requirements
3-50     of the commission as such rules and requirements exist on the date
3-51     of annexation; and
3-52                 (2)  after the annexation, install all necessary water,
3-53     wastewater, and drainage facilities to serve full buildout of
3-54     development within the district.
3-55           ARTICLE 2.  HORSESHOE BAY WATER CONTROL AND IMPROVEMENT
3-56                               DISTRICT NO. 2
3-57           SECTION 2.01.  CREATION.  (a)  A conservation and reclamation
3-58     district, to be known as Horseshoe Bay Water Control and
3-59     Improvement District No. 2, is created in Llano County, subject to
3-60     approval at a confirmation election under Section 2.09 of this
3-61     article.  The district is a governmental agency and a body politic
3-62     and corporate.
3-63           (b)  The district is created under and is essential to
3-64     accomplish the purposes of Section 59, Article XVI, Texas

 4-5     Madison Putman Survey No. 672, Abstract No. 587, the A. Murchison
 4-6     Survey No. 85, Abstract No. 556, the J. McFarland Survey No. 1005,
 4-7     Abstract No. 555 and the Nicholas Mendez Survey No. 3, Abstract No.
 4-8     506 of Llano County, Texas, and consisting of all of those certain
 4-9     548.638 acres conveyed to Norman C. Hurd, Trustee # 1, recorded in
4-10     Volume 385, Page 176, 0.372 acre conveyed to Norman C. Hurd,
4-11     Trustee # 1, recorded in Volume 385, Page 173, 11.036 acres
4-12     conveyed to Norman C. Hurd, Trustee # 1, recorded in Volume 408,
4-13     Page 7, 183.898 acres conveyed to Norman C. Hurd, Trustee # 1,
4-14     recorded in Volume 384, Page 148, 12.085 acres conveyed to Norman

7-38           SECTION 2.04.  FINDINGS RELATING TO BOUNDARIES.  The
7-39     legislature finds that the boundaries and field notes of the
7-40     district form a closure.  A mistake in the field notes or in
7-41     copying the field notes in the legislative process does not affect
7-42     the organization, existence, or validity of the district, the right
7-43     of the district to levy and collect taxes, or the legality or
7-44     operation of the district or its governing body.
7-45           SECTION 2.05.  FINDING OF BENEFIT.  All of the land and other
7-46     property included within the boundaries of the district will be
7-47     benefited by the works and projects that are to be accomplished by
7-48     the district under the powers conferred by Section 59, Article XVI,
7-49     Texas Constitution.  The district is created to serve a public use
7-50     and benefit.
7-51           SECTION 2.06.  POWERS.  (a)  The district has all of the
7-52     rights, powers, privileges, authority, functions, and duties
7-53     provided by the general law of this state, including Chapters 49
7-54     and 51, Water Code, applicable to water control and improvement
7-55     districts created under Section 59, Article XVI, Texas
7-56     Constitution.  This article prevails over any provision of general
7-57     law that is in conflict or inconsistent with this article.
7-58           (b)  The rights, powers, privileges, authority, functions,
7-59     and duties of the district are subject to the continuing right of
7-60     supervision of the state to be exercised by and through the
7-61     commission.
7-62           SECTION 2.07.  BOARD OF DIRECTORS.  (a)  The district is
7-63     governed by a board of five directors.
7-64           (b)  Temporary directors serve until initial permanent
7-65     directors are elected under Section 2.09 of this article.
7-66           (c)  Initial permanent directors serve until permanent
7-67     directors are elected under Section 2.10 of this article.
7-68           (d)  Permanent directors other than initial permanent
7-69     directors serve staggered four-year terms.
 8-1           (e)  Each director must qualify to serve as director in the
 8-2     manner provided by Section 49.055, Water Code.
 8-3           (f)  A director serves until the director's successor has
 8-4     qualified.
 8-5           SECTION 2.08.  TEMPORARY DIRECTORS.  (a)  The temporary board
 8-6     of directors is composed of:
 8-7                 (1)  Glena Yates;
 8-8                 (2)  Steve Bartholomew;
 8-9                 (3)  Mike Smith;
8-10                 (4)  Val White; and
8-11                 (5)  Sandy Senter.
8-12           (b)  If a temporary director fails to qualify for office, the
8-13     temporary directors who have qualified shall appoint a person to
8-14     fill the vacancy.  If at any time there are fewer than three
8-15     qualified temporary directors, the commission shall appoint the
8-16     necessary number of persons to fill all vacancies on the board.
8-17           SECTION 2.09.  CONFIRMATION AND INITIAL DIRECTORS' ELECTION.
8-18     The temporary board of directors shall call and hold an election to
8-19     confirm establishment of the district and to elect five initial
8-20     directors as provided by Chapter 49, Water Code.
8-21           SECTION 2.10.  ELECTION OF DIRECTORS.  On the first Saturday
8-22     in May of the fourth year after the year in which the confirmation
8-23     election is held, an election shall be held in the district for the
8-24     election of two directors who shall serve two-year terms and three
8-25     directors who shall serve four-year terms.  Thereafter, on the same
8-26     date in each subsequent second year, the appropriate number of
8-27     directors shall be elected to the board.
8-28           SECTION 2.11.  PROHIBITION AGAINST IMPAIRMENT OF DISTRICT.  A
8-29     municipality in whose extraterritorial jurisdiction the district is
8-30     located may not adopt an ordinance or resolution or take any other
8-31     action that:
8-32                 (1)  impairs the ability of the district to exercise
8-33     its powers under this article; or
8-34                 (2)  limits the ability of the district to finance,
8-35     construct, or operate its water, wastewater, or drainage systems.
8-36           SECTION 2.12.  ANNEXATION.  (a)  The district may be annexed
8-37     by a municipality on the earlier of:
8-38                 (1)  the date of installation of 90 percent of all
8-39     works, improvements, facilities, plants, equipment, and appliances
8-40     necessary and adequate to:
8-41                       (A)  provide service to the proposed development
8-42     within the district;
8-43                       (B)  accomplish the purposes for which the
8-44     district was created; and
8-45                       (C)  exercise the powers provided by the general
8-46     law of this state and this article; or
8-47                 (2)  the 20th anniversary of the date the district is
8-48     confirmed.
8-49           (b)  The district may add or exclude land or divide into two
8-50     or more districts, in the manner provided by Chapters 49 and 51,
8-51     Water Code, without the consent of any municipality.
8-52           SECTION 2.13.  REIMBURSEMENT TO LANDOWNER OR DEVELOPER;
8-53     INSTALLATION OF FACILITIES.  If a municipality in whose
8-54     extraterritorial jurisdiction the district is located annexes the
8-55     district for full or limited purposes and the annexation precludes
8-56     or impairs the ability of the district to issue bonds, the
8-57     municipality shall:
8-58                 (1)  simultaneously with the annexation, pay in cash to
8-59     the landowner or developer of the district a sum equal to all
8-60     actual costs and expenses incurred by the landowner or developer in
8-61     connection with the district that the district has, in writing,
8-62     agreed to pay and that would otherwise have been eligible for
8-63     reimbursement from bond proceeds under the rules and requirements
8-64     of the commission as such rules and requirements exist on the date
8-65     of annexation; and
8-66                 (2)  after the annexation, install all necessary water,
8-67     wastewater, and drainage facilities to serve full buildout of
8-68     development within the district.
 9-1           ARTICLE 3.  HORSESHOE BAY WATER CONTROL AND IMPROVEMENT
 9-2                               DISTRICT NO. 3
 9-3           SECTION 3.01.  CREATION.  (a)  A conservation and reclamation
 9-4     district, to be known as Horseshoe Bay Water Control and
 9-5     Improvement District No. 3, is created in Llano County, subject to
 9-6     approval at a confirmation election under Section 3.09 of this
 9-7     article.  The district is a governmental agency and a body politic
 9-8     and corporate.
 9-9           (b)  The district is created under and is essential to
9-10     accomplish the purposes of Section 59, Article XVI, Texas
9-11     Constitution.
9-12           SECTION 3.02.  DEFINITIONS.  In this article:
9-13                 (1)  "Commission" means the Texas Natural Resource
9-14     Conservation Commission.
9-15                 (2)  "District" means Horseshoe Bay Water Control and
9-16     Improvement District No. 3.
9-17           SECTION 3.03.  BOUNDARIES.  The district includes the
9-18     territory contained within the following area:
9-19     A 549.969 acre tract of land out of the Levi Mercer Survey No. 2
9-20     consisting of all of that certain 27.002 acre tract of land
9-21     conveyed by James E. Bauerle et. ux. to Sidney S. McClendon III,
9-22     Trustee, described in a Warranty Deed recorded June 6, 1977 in
9-23     Volume 220, Pages 326-332 of the Llano County Deed Records, a
9-24     portion of that certain 14.93 acre tract of land described as
9-25     Exhibit "C", a portion of that certain 765.315 acre tract of land
9-26     described as Exhibit "A" and all of that certain Tract Two of
9-27     192.117 acres in a Warranty Deed from Buena Vista Corporation to
9-28     Sidney McClendon III, dated August 1, 1977 and recorded in Volume
9-29     220, Pages 750-760 of the Llano County Deed Records, Llano County,
9-30     Texas, being the same called 549.972 acre tract conveyed to Morris
9-31     D. Jaffe, Jr. by Special Warranty Deed with Vendor's Lien, dated

23-44          SECTION 3.04.  FINDINGS RELATING TO BOUNDARIES.  The
23-45    legislature finds that the boundaries and field notes of the
23-46    district form a closure.  A mistake in the field notes or in
23-47    copying the field notes in the legislative process does not affect
23-48    the organization, existence, or validity of the district, the right
23-49    of the district to levy and collect taxes, or the legality or
23-50    operation of the district or its governing body.
23-51          SECTION 3.05.  FINDING OF BENEFIT.  All of the land and other
23-52    property included within the boundaries of the district will be
23-53    benefited by the works and projects that are to be accomplished by
23-54    the district under the powers conferred by Section 59, Article XVI,
23-55    Texas Constitution.  The district is created to serve a public use
23-56    and benefit.
23-57          SECTION 3.06.  POWERS.  (a)  The district has all of the
23-58    rights, powers, privileges, authority, functions, and duties
23-59    provided by the general law of this state, including Chapters 49
23-60    and 51, Water Code, applicable to water control and improvement
23-61    districts created under Section 59, Article XVI, Texas
23-62    Constitution.  This article prevails over any provision of general
23-63    law that is in conflict or inconsistent with this article.
23-64          (b)  The rights, powers, privileges, authority, functions,
23-65    and duties of the district are subject to the continuing right of
23-66    supervision of the state to be exercised by and through the
23-67    commission.
23-68          SECTION 3.07.  BOARD OF DIRECTORS.  (a)  The district is
23-69    governed by a board of five directors.
 24-1          (b)  Temporary directors serve until initial permanent
 24-2    directors are elected under Section 3.09 of this article.
 24-3          (c)  Initial permanent directors serve until permanent
 24-4    directors are elected under Section 3.10 of this article.
 24-5          (d)  Permanent directors other than initial permanent
 24-6    directors serve staggered four-year terms.
 24-7          (e)  Each director must qualify to serve as director in the
 24-8    manner provided by Section 49.055, Water Code.
 24-9          (f)  A director serves until the director's successor has
24-10    qualified.
24-11          SECTION 3.08.  TEMPORARY DIRECTORS.  (a)  The temporary board
24-12    of directors is composed of:
24-13                (1)  Mindy Rowe;
24-14                (2)  Leon Stewart;
24-15                (3)  Jennie Thibodeaux;
24-16                (4)  Dave Cleary; and
24-17                (5)  Gary Turner.
24-18          (b)  If a temporary director fails to qualify for office, the
24-19    temporary directors who have qualified shall appoint a person to
24-20    fill the vacancy.  If at any time there are fewer than three
24-21    qualified temporary directors, the commission shall appoint the
24-22    necessary number of persons to fill all vacancies on the board.
24-23          SECTION 3.09.  CONFIRMATION AND INITIAL DIRECTORS' ELECTION.
24-24    The temporary board of directors shall call and hold an election to
24-25    confirm establishment of the district and to elect five initial
24-26    directors as provided by Chapter 49, Water Code.
24-27          SECTION 3.10.  ELECTION OF DIRECTORS.  On the first Saturday
24-28    in May of the fourth year after the year in which the confirmation
24-29    election is held, an election shall be held in the district for the
24-30    election of two directors who shall serve two-year terms and three
24-31    directors who shall serve four-year terms.  Thereafter, on the same
24-32    date in each subsequent second year, the appropriate number of
24-33    directors shall be elected to the board.
24-34          SECTION 3.11.  PROHIBITION AGAINST IMPAIRMENT OF DISTRICT.  A
24-35    municipality in whose extraterritorial jurisdiction the district is
24-36    located may not adopt an ordinance or resolution or take any other
24-37    action that:
24-38                (1)  impairs the ability of the district to exercise
24-39    its powers under this article; or
24-40                (2)  limits the ability of the district to finance,
24-41    construct, or operate its water, wastewater, or drainage systems.
24-42          SECTION 3.12.  ANNEXATION.  (a)  The district may be annexed
24-43    by a municipality on the earlier of:
24-44                (1)  the date of installation of 90 percent of all
24-45    works, improvements, facilities, plants, equipment, and appliances
24-46    necessary and adequate to:
24-47                      (A)  provide service to the proposed development
24-48    within the district;
24-49                      (B)  accomplish the purposes for which the
24-50    district was created; and
24-51                      (C)  exercise the powers provided by the general
24-52    law of this state and this article; or
24-53                (2)  the 20th anniversary of the date the district is
24-54    confirmed.
24-55          (b)  The district may add or exclude land or divide into two
24-56    or more districts, in the manner provided by Chapters 49 and 51,
24-57    Water Code, without the consent of any municipality.
24-58          SECTION 3.13.  REIMBURSEMENT TO LANDOWNER OR DEVELOPER;
24-59    INSTALLATION OF FACILITIES.  If a municipality in whose
24-60    extraterritorial jurisdiction the district is located annexes the
24-61    district for full or limited purposes and the annexation precludes
24-62    or impairs the ability of the district to issue bonds, the
24-63    municipality shall:
24-64                (1)  simultaneously with the annexation, pay in cash to
24-65    the landowner or developer of the district a sum equal to all
24-66    actual costs and expenses incurred by the landowner or developer in
24-67    connection with the district that the district has, in writing,
24-68    agreed to pay and that would otherwise have been eligible for
24-69    reimbursement from bond proceeds under the rules and requirements
 25-1    of the commission as such rules and requirements exist on the date
 25-2    of annexation; and
 25-3                (2)  after the annexation, install all necessary water,
 25-4    wastewater, and drainage facilities to serve full buildout of
 25-5    development within the district.
 25-6                     ARTICLE 4.  FINDINGS RELATING TO
 25-7                    PROCEDURAL REQUIREMENTS; EMERGENCY
 25-8          SECTION 4.01.  FINDINGS RELATING TO PROCEDURAL REQUIREMENTS.
 25-9    (a)  The proper and legal notice of the intention to introduce this
25-10    Act, setting forth the general substance of this Act, has been
25-11    published as provided by law, and the notice and a copy of this Act
25-12    have been furnished to all persons, agencies, officials, or
25-13    entities to which they are required to be furnished by the
25-14    constitution and other laws of this state, including the governor,
25-15    who has submitted the notice and Act to the Texas Natural Resource
25-16    Conservation Commission.
25-17          (b)  The Texas Natural Resource Conservation Commission has
25-18    filed its recommendations relating to this Act with the governor,
25-19    lieutenant governor, and speaker of the house of representatives
25-20    within the required time.
25-21          (c)  All requirements of the constitution and laws of this
25-22    state and the rules and procedures of the legislature with respect
25-23    to the notice, introduction, and passage of this Act are fulfilled
25-24    and accomplished.
25-25          SECTION 4.02.  EMERGENCY.  The importance of this legislation
25-26    and the crowded condition of the calendars in both houses create an
25-27    emergency and an imperative public necessity that the
25-28    constitutional rule requiring bills to be read on three several
25-29    days in each house be suspended, and this rule is hereby suspended,
25-30    and that this Act take effect and be in force from and after its
25-31    passage, and it is so enacted.
