                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the biennial transfer of revenue to the economic
 1-3     stabilization fund.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter F, Chapter 403, Government Code, is
 1-6     amended by adding Section 403.091 to read as follows:
 1-7           Sec. 403.091.  TRANSFER OF CERTAIN BALANCES TO ECONOMIC
 1-8     STABILIZATION FUND.  (a)  For the purpose of computing the amount
 1-9     to be transferred biennially to the economic stabilization fund
1-10     under Section 49-g(b), Article III, Texas Constitution, the
1-11     comptroller shall deduct from the cash balance available for
1-12     certification under Section 403.121 only:
1-13                 (1)  agency encumbrances as reported to the
1-14     comptroller;
1-15                 (2)  any balances in the accounts dedicated by Section
1-16     31, Article I, Texas Constitution; and
1-17                 (3)  the balance of any dedicated account in the
1-18     general revenue fund that consists exclusively of gifts or
1-19     donations.
1-20           (b)  In making a transfer under Section 49-g(b), Article III,
1-21     Texas Constitution, the comptroller shall reduce proportionally the
1-22     unencumbered balance of the undedicated portion of the general
1-23     revenue fund and of each dedicated account in the general revenue
1-24     fund, other than an account described by Subsection (a)(2) or
 2-1     (a)(3).
 2-2           (c)  For the purpose of this section, an account consists of
 2-3     donations if money in the account has been expressly donated or
 2-4     paid, in addition to a fee required for the goods or services
 2-5     provided, as a voluntary fee to support a particular program.
 2-6           SECTION 2.  This Act takes effect September 1, 2000.
 2-7           SECTION 3.  The importance of this legislation and the
 2-8     crowded condition of the calendars in both houses create an
 2-9     emergency and an imperative public necessity that the
2-10     constitutional rule requiring bills to be read on three several
2-11     days in each house be suspended, and this rule is hereby suspended.
