                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the duties and salary of the county attorney in Oldham
 1-2     County.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 45.280, Government Code, is amended to
 1-5     read as follows:
 1-6           Sec. 45.280.  OLDHAM COUNTY.  (a)  The county attorney in
 1-7     Oldham County shall represent the state in all matters pending
 1-8     before the district court in Oldham County.
 1-9           (b)  The county attorney in Oldham County is entitled to be
1-10     compensated by the state in the manner and amount provided by
1-11     general law relating to the salary paid to district attorneys by
1-12     the state.  Oldham County shall pay $28,500 of the county
1-13     attorney's total salary, and the state shall pay the remainder of
1-14     the salary.
1-15           (c)  If there is no county attorney in Oldham County, the
1-16     criminal district attorney of Deaf Smith County shall represent the
1-17     state in all matters pending before the district court in Oldham
1-18     County on appointment by the judge of the district court in Oldham
1-19     County.
1-20           [(b) Oldham County is entitled to receive an amount from the
1-21     state equal to 30 percent of the salary paid to a district attorney
1-22     by the state.]
1-23           SECTION 2.  This Act takes effect September 1, 1999.
1-24           SECTION 3.  The importance of this legislation and the
 2-1     crowded condition of the calendars in both houses create an
 2-2     emergency and an imperative public necessity that the
 2-3     constitutional rule requiring bills to be read on three several
 2-4     days in each house be suspended, and this rule is hereby suspended.
