AN ACT 1-1 relating to the state participation program of the Texas Water 1-2 Development Board. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter E, Chapter 16, Water Code, is amended 1-5 by adding Section 16.142 to read as follows: 1-6 Sec. 16.142. RECOVERY OF ADMINISTRATIVE COSTS. (a) The 1-7 board may charge an administrative fee to a political subdivision 1-8 with which the board agrees to participate in a project under this 1-9 subchapter. 1-10 (b) The board by rule shall set the fee at an amount it 1-11 considers necessary to recover the costs incurred or to be incurred 1-12 by the board in administering the project over its life, including 1-13 the costs of processing an application, monitoring construction, 1-14 and auditing and monitoring the project. The state auditor shall 1-15 review fees charged by the board to determine whether the fees are 1-16 set consistent with this subsection. 1-17 (c) The board may require the payment of the fee in one or 1-18 more payments. 1-19 (d) Fees shall be deposited as directed by the board for use 1-20 in administering the program. 1-21 SECTION 2. This Act takes effect September 1, 1999. 1-22 SECTION 3. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 1-24 emergency and an imperative public necessity that the 2-1 constitutional rule requiring bills to be read on three several 2-2 days in each house be suspended, and this rule is hereby suspended. _______________________________ _______________________________ President of the Senate Speaker of the House I hereby certify that S.B.
