By Ratliff S.B. No. 1862 Substitute the following for S.B. No. 1862: By Heflin C.S.S.B. No. 1862 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the state participation program of the Texas Water 1-3 Development Board. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter E, Chapter 16, Water Code, is amended 1-6 by adding Section 16.142 to read as follows: 1-7 Sec. 16.142. RECOVERY OF ADMINISTRATIVE COSTS. (a) The 1-8 board may charge an administrative fee to a political subdivision 1-9 with which the board agrees to participate in a project under this 1-10 subchapter. 1-11 (b) The board by rule shall set the fee at an amount it 1-12 considers necessary to recover the costs incurred or to be incurred 1-13 by the board in administering the project over its life, including 1-14 the costs of processing an application, monitoring construction, 1-15 and auditing and monitoring the project. The state auditor shall 1-16 review fees charged by the board to determine whether the fees are 1-17 set consistent with this subsection. 1-18 (c) The board may require the payment of the fee in one or 1-19 more payments. 1-20 (d) Fees shall be deposited as directed by the board for use 1-21 in administering the program. 1-22 SECTION 2. This Act takes effect September 1, 1999. 1-23 SECTION 3. The importance of this legislation and the 2-1 crowded condition of the calendars in both houses create an 2-2 emergency and an imperative public necessity that the 2-3 constitutional rule requiring bills to be read on three several 2-4 days in each house be suspended, and this rule is hereby suspended.
