No. 1862 1-2 (In the Senate - Filed April 13, 1999; April 14, 1999, read 1-3 first time and referred to Committee on Finance; April 19, 1999, 1-4 reported favorably by the following vote: Yeas 11, Nays 0; 1-5 April 19, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the state participation program of the Texas Water 1-9 Development Board. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter E, Chapter 16, Water Code, is amended 1-12 by adding Section 16.142 to read as follows: 1-13 Sec. 16.142. RECOVERY OF ADMINISTRATIVE COSTS. (a) The 1-14 board may charge an administrative fee to a political subdivision 1-15 with which the board agrees to participate in a project under this 1-16 subchapter. 1-17 (b) The board by rule shall set the fee at an amount it 1-18 considers necessary to recover the costs incurred or to be incurred 1-19 by the board in administering the project over its life, including 1-20 the costs of processing an application, monitoring construction, 1-21 and auditing and monitoring the project. 1-22 (c) The board may require the payment of the fee in one or 1-23 more payments. 1-24 (d) Fees shall be deposited as directed by the board for use 1-25 in administering the program. 1-26 SECTION 2. This Act takes effect September 1, 1999. 1-27 SECTION 3. The importance of this legislation and the 1-28 crowded condition of the calendars in both houses create an 1-29 emergency and an imperative public necessity that the 1-30 constitutional rule requiring bills to be read on three several 1-31 days in each house be suspended, and this rule is hereby suspended. 1-32 * * * * *
