No. 1872 as follows: 1-8 (1) Strike Section 284.009(b) and substitute the following: 1-9 (b) A county may not sell or otherwise transfer a toll road 1-10 project to any other public or private entity if the project was 1-11 built using right-of-way acquired from the state without the 1-12 express written consent of and consultation with the Texas 1-13 Department of Transportation. 1-14 (2) Strike Section 365.016(b) and substitute the following: 1-15 (b) A district may not sell or otherwise transfer a toll 1-16 road project to any other public or private entity if the project 1-17 was built using right-of-way acquired from the state without the 1-18 express written consent of and consultation with the Texas 1-19 Department of Transportation. 1-20 A BILL TO BE ENTITLED 1-21 AN ACT 1-22 relating to the sale of certain toll roads by certain political 1-23 subdivisions. 1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-25 SECTION 1. Subchapter A, Chapter 284, Transportation Code, 1-26 is amended by adding Section 284.009 to read as follows: 1-27 Sec. 284.009. SALE OF CERTAIN TOLL ROADS PROHIBITED. 1-28 (a) This section applies only to a county with a population of 2.8 1-29 million or more. 1-30 (b) A county may not sell or otherwise transfer a toll road 1-31 project to any other public or private entity if the project was 1-32 built using right-of-way acquired from the state. 1-33 (c) This section expires January 1, 2002. 1-34 SECTION 2. Subchapter B, Chapter 365, Transportation Code, 1-35 is amended by adding Section 365.016 to read as follows: 1-36 Sec. 365.016. SALE OF CERTAIN TOLL ROADS PROHIBITED. 1-37 (a) This section applies only to a district any portion of which 1-38 is located in a county with a population of 2.8 million or more. 1-39 (b) A district may not sell or otherwise transfer a toll 1-40 road project to any other public or private entity if the project 1-41 was built using right-of-way acquired from the state. 1-42 (c) This section expires January 1, 2002. 1-43 SECTION 3. The importance of this legislation and the 1-44 crowded condition of the calendars in both houses create an 1-45 emergency and an imperative public necessity that the 1-46 constitutional rule requiring bills to be read on three several 1-47 days in each house be suspended, and this rule is hereby suspended, 1-48 and that this Act take effect and be in force from and after its 1-49 passage, and it is so enacted. 1-50 * * * * *
