                                 A JOINT RESOLUTION
 1-1     proposing a constitutional amendment relating to transactions in
 1-2     connection with an encumbrance on a homestead by an incapacitated
 1-3     person.
 1-4           BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 50, Article XVI, Texas Constitution, is
 1-6     amended by adding Subsection (t) to read as follows:
 1-7           (t)  If this section requires consent or execution of a
 1-8     contract by a person's spouse and that spouse is incapacitated, the
 1-9     consent or execution of the contract by the incapacitated spouse
1-10     may be obtained as provided by law for the giving of consent or
1-11     execution of a contract for an incapacitated person.
1-12           SECTION 2.  This proposed constitutional amendment shall be
1-13     submitted to the voters at an election to be held November 2, 1999.
1-14     The ballot shall be printed to permit voting for or against the
1-15     proposition:  "The constitutional amendment making law applicable
1-16     to incapacitated persons apply to the giving of consent or
1-17     execution of a contract by an incapacitated person in relation to
1-18     an extension of credit secured by a homestead."
