                                 R E S O L U T I O N
 1-1           BE IT RESOLVED by the Senate of the State of Texas, 76th
 1-2     Legislature, Regular Session, 1999, That Senate Rule 12.03 be
 1-3     suspended, as provided by Senate Rule 12.08, to enable the
 1-4     conference committee appointed to resolve the differences between
 1-5     the house and senate versions of S.B. No. 1423, relating to
 1-6     providing supplemental financial assistance and services to certain
 1-7     grandparents, to consider and take action on the following matter:
 1-8           Senate Rules 12.03(1), (2), and (4) are suspended to permit
 1-9     the committee to amend Section 1 of the bill to read as follows:
1-10           SECTION 1.  Subchapter A, Chapter 31, Human Resources Code,
1-11     is amended by adding Section 31.0041 to read as follows:
1-12           Sec. 31.0041.  SUPPLEMENTAL FINANCIAL ASSISTANCE FOR CERTAIN
1-13     PERSONS.  (a)  To the extent funds are appropriated for this
1-14     purpose, the department may provide supplemental financial
1-15     assistance in addition to the amount of financial assistance
1-16     granted for the support of a dependent child under Section 31.003
1-17     to a person who:
1-18                 (1)  is 50 years of age or older;
1-19                 (2)  is the grandparent of the dependent child, as
1-20     defined by Section 31.002, who lives at the person's residence;
1-21                 (3)  is the primary caretaker of the dependent child;
1-22                 (4)  has a family income that is at or below 100
1-23     percent of the federal poverty level; and
1-24                 (5)  does not have resources that exceed the amount
 2-1     allowed for financial assistance under this chapter.
 2-2           (b)  Supplemental financial assistance provided to a person
 2-3     under this section may include one or more cash payments, not to
 2-4     exceed a total of $1,000, after determination of eligibility for
 2-5     supplemental financial assistance under this section.
 2-6           (c)  The department shall inform an applicant for financial
 2-7     assistance under this chapter who meets the eligibility
 2-8     requirements under Subsection (a) of the availability of
 2-9     supplemental financial assistance.
2-10           (d)  The department shall maintain complete records and
2-11     compile statistics regarding the number of households that receive
2-12     supplemental financial assistance under this section.
2-13           (e)  After a person receives supplemental financial
2-14     assistance under Subsection (b) on behalf of a dependent child, no
2-15     other person is eligible under Subsection (a) to receive
2-16     supplemental financial assistance on behalf of that child.
2-17           Explanation:  This amendment is necessary to limit
2-18     eligibility for supplemental financial assistance provided by
2-19     Section 31.0041, Human Resources Code, as added by the bill, and to
2-20     allow the Texas Department of Human Services to provide
2-21     supplemental financial assistance to the extent funds are
2-22     appropriated for that purpose.
