                                  SENATE RESOLUTION
 1-1           BE IT RESOLVED by the Senate of the State of Texas, 76th
 1-2     Legislature, Regular Session, 1999, That Senate Rule 12.03 be
 1-3     suspended in part as provided by Senate Rule 12.08 to enable the
 1-4     conference committee appointed to resolve the differences on H.B.
 1-5     No. 3697, relating to the operation of the Texas Workers'
 1-6     Compensation Insurance Fund and the disposition of certain
 1-7     surpluses of that fund, to consider and take action on the
 1-8     following matters:
 1-9           (1)  Senate Rules 12.03(3) and (4) are suspended to permit
1-10     the committee to add text incorporating a new section in the bill,
1-11     appropriately numbered, to amend Section 5(10), Article 21.28-C,
1-12     Insurance Code, to read as follows:
1-13           SECTION ______. Section 5(10), Article 21.28-C, Insurance
1-14     Code, is amended to read as follows:
1-15                 (10)  "Member insurer" means any insurer [person] who:
1-16                       (A)  writes any kind of insurance to which this
1-17     Act applies under Section 3 of this Act, including the exchange of
1-18     reciprocal or inter-insurance contracts; and
1-19                       (B)  is licensed to transact insurance in this
1-20     state, including any stock, mutual, Lloyds insurer, reciprocal or
1-21     inter-insurance exchange, or county mutual insurance company.
1-22           Explanation:  This change is necessary to clarify membership
1-23     in the Texas Property and Casualty Insurance Guaranty Association,
1-24     which will now include the Texas Workers' Compensation Insurance
 2-1     Fund.
