No. 1173 SENATE RESOLUTION 1-1 BE IT RESOLVED by the Senate of the State of Texas, That 1-2 Senate Rule 12.03 be suspended, as provided by Senate Rule 12.08, 1-3 to enable the conference committee appointed to resolve the 1-4 differences between the house and senate versions of H.B. No. 1275, 1-5 relating to providing a parent with a copy of a special education 1-6 student's education plan translated into the parent's native 1-7 language, to consider and take action on the following matter: 1-8 Senate Rules 12.03(3) and (4) are suspended to permit the 1-9 committee to add text to read as follows: 1-10 SECTION 1. Section 29.005, Education Code, is amended by 1-11 adding Subsection (d) to read as follows: 1-12 (d) If the child's parent is unable to speak English, the 1-13 district shall: 1-14 (1) provide the parent with a written or audiotaped 1-15 copy of the child's individualized education program translated 1-16 into Spanish if Spanish is the parent's native language; or 1-17 (2) if the parent's native language is a language 1-18 other than Spanish, make a good faith effort to provide the parent 1-19 with a written or audiotaped copy of the child's individualized 1-20 education program translated into the parent's native language. 1-21 SECTION 2. The importance of this legislation and the 1-22 crowded condition of the calendars in both houses create an 1-23 emergency and an imperative public necessity that the 1-24 constitutional rule requiring bills to be read on three several 2-1 days in each house be suspended, and this rule is hereby suspended, 2-2 and that this Act take effect and be in force from and after its 2-3 passage, and it is so enacted. 2-4 Explanation: This change is necessary to require a school 2-5 district to provide a copy of an individualized education program 2-6 in Spanish if a parent's native language is Spanish, and to 2-7 require, if a parent's native language is a language other than 2-8 Spanish, a good faith effort to provide the copy in that language. 2-9 ______________________________________ 2-10 President of the Senate 2-11 I hereby certify that the above 2-12 Resolution was adopted by the Senate 2-13 on May 29, 1999, by the following. 2-14 vote: Yeas 30, Nays 0. 2-15 ______________________________________ 2-16 Secretary of the Senate
