                                 R E S O L U T I O N
 1-1           BE IT RESOLVED by the Senate of the State of Texas, That
 1-2     Senate Rule 12.03 is suspended, as provided by Senate Rule 12.08,
 1-3     to enable the conference committee appointed to resolve the
 1-4     differences between the house and senate versions of H.B. No.
 1-5     1275, relating to providing a parent with a copy of a special
 1-6     education student's education plan translated into the parent's
 1-7     native language, to consider and take action on the following
 1-8     matter:
 1-9           Senate Rules 12.03(3) and (4) are suspended to permit the
1-10     committee to add text to read as follows:
1-11           SECTION 1.  Section 29.005, Education Code, is amended by
1-12     adding Subsection (d) to read as follows:
1-13           (d)  If the child's parent is unable to speak English, the
1-14     district shall:
1-15                 (1)  provide the parent with a written or audiotaped
1-16     copy of the child's individualized education program translated
1-17     into Spanish if Spanish is the parent's native language; or
1-18                 (2)  if the parent's native language is a language
1-19     other than Spanish, make a good faith effort to provide the parent
1-20     with a written or audiotaped copy of the child's individualized
1-21     education program translated into the parent's native language.
1-22           SECTION 2.  The importance of this legislation and the
1-23     crowded condition of the calendars in both houses create an
1-24     emergency and an imperative public necessity that the
 2-1     constitutional rule requiring bills to be read on three several
 2-2     days in each house be suspended, and this rule is hereby suspended,
 2-3     and that this Act take effect and be in force from and after its
 2-4     passage, and it is so enacted.
 2-5           Explanation:  This change is necessary to require a school
 2-6     district to provide a copy of an individualized education program
 2-7     in Spanish if a parent's native language is Spanish, and to
 2-8     require, if a parent's native language is a language other than
 2-9     Spanish, a good faith effort to provide the copy in that language.
