LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 76th Regular Session May 11, 1999 TO: Honorable Ken Armbrister, Chair, Senate Committee on Criminal Justice FROM: John Keel, Director, Legislative Budget Board IN RE: HB1535 by Allen (Relating to the eligibility for community supervision or parole for certain defendants convicted of sexual assault.), As Engrossed ************************************************************************** * No significant fiscal implication to the State is anticipated. * * * * The bill would make no appropriation but could provide the legal * * basis for an appropriation of funds to implement the provisions of * * the bill. * ************************************************************************** The bill would amend the Code of Criminal Procedure by eliminating the possibility of judge ordered community supervision for all offenders adjudged guilty of the offense of sexual assault. The bill would also require all persons adjudged guilty of sexual assault to serve in actual calendar time, one-half of their sentence or 30 calendar years, whichever is less, but in no event would the inmate be eligible for release on parole in less than two years. Under current law and policy, the average time served in prison by persons likely to be affected by the provisions of this bill is greater than five years. Therefore, no significant impact on demands on the adult corrections agencies is anticipated during the first five years following passage.
