Pursuant to a notice posted on March 9, 1999, the House
Committee on Appropriations met in a public hearing and was
called to order by the chair, Representative Robert Junell at
7:15 am.

Representative Janek moved the adoption of LBB recommendations
with one change to performance measures and the addition of
New Generation Medication, Caseload Growth in Home and
Community Basic Services Waiver, Fund additional slots on Home
and Community Bases Services Waiting List, Increase Funding
for State School Services, Transfer of employee benefits
costs, In-home and family support for mental retardation
services, Intensive Integrated Care, Supported Employment
(Mental Retardation), Gulf Coast Regional Community
Psychiatric Hospitals and Capital Projects (asbestos removal).
Add State School Funding and Staffing Levels rider (Eiland
#1), Appropriation Transfer between Fiscal Years rider (Janek
#1), Employee Benefits Costs - Transition of Services to Local
control rider (Janek #2), Use of Timber Receipts for Capital
Projects rider (Janek #3), Reimbursement of Advisory Committee
Members (Janek #4), Option of State School Placement (Hartnett
#1), Gulf Coast Regional Community Psychiatric Hospital
(Eiland #5), Amend Capital Budget rider (Eiland #6). Add
Proposed Fending for strategy D.1.1 (Janek #6) and Maximum
Security Salaries rider (Janek #7). Without objection, the
motion was adopted.
At 12:45 pm, on the motion of the chair and without objection,
the meeting was recessed until
1:45 pm.
The committee reconvened at 2:16 pm and was called to order by
the chair, Representative Junell. The roll was answered as

Criminal Justice (pending items)
Office of the Attorney General
Representative Turner moved the adoption of the following
pending items: Child Support Enforcement rider, Performance
measure change for number of children served by
court-appointed volunteers, Performance measure change for
total number of counties served by CASA program and
Contingency Rider on HB 2298. Without objection, the motion
was adopted.
Judiciary
Representative Turner moved the adoption of the following
pending items: Performance measure for strikeforce panels,
Funding for increase judges' salaries for the 11th Court of
Appeals, Funding for increase judges' salaries for the 12th
Court of Appeals, UB Authority for the 4th Court of Appeals
and Rider for district court performance measures. Without
objection, the motion was adopted.
Judiciary Section
Representative Turner moved the adoption of the following
pending item: Rider for Public Integrity Unit to limit
expenditures for additional staff to increased collections.
Without objection, the motion was adopted.
Alcoholic Beverage Commission
Representative Turner moved the adoption of the following
pending items: Contingency rider for new bridge enforcement
as amended and a rider for notification to local distributors.
Without objection, the motion was adopted.
Texas Department of Criminal Justice
Representative Turner moved the adoption of the following
pending items: rider for misdemeanor supervision, deleting
reference to 182 days and reference statutory time period,
funding for correctional managed health care for increased
costs and to maintain reserves, funding for Harris County boot
camp and funding for Project RIO moved back to Workforce
Commission. Without objection, the motion was adopted.
Juvenile Probation Commission
Representative Turner moved the adoption of the following
pending items: Funding for additional secure placements, hold
harmless provision, post-adjudication beds, modify Rider 8 to
be consistent with secure placements decisions and modify
rider 11 to be consistent with JJAEP decisions. Without
objection, the motion was adopted.
Department of Public Safety
Representative Turner moved the adoption of the following
pending items: Driver license office wait time rider,
Restriction of vehicle use rider, Florence property rider,
Firearms training facility rider, Security for State History
Museum rider, Reporting procedure for land acquisitions and
construction projects rider, Use of non-commissioned staff for
license and weight duties rider as amended and Division of
Emergency Management rider. Without objection, the motion was
adopted.
Youth Commission
Representative Turner moved the adoption of the following
pending item: Modify Rider 3 to be consistent with
Comptroller's Estimate. Without objection, the motion was
adopted.
Article V Special Provisions
Representative Turner moved the adoption of the following
pending item: Coordinate radio conversion per FCC requirement
rider. Without objection, the motion was adopted.
Regulatory (pending items)
Texas Department of Agriculture
Representative McReynolds moved the adoption of the following
pending items: Revise Octane Testing Program and add Oyster
Promotion Contingency rider (McReynolds #2). Without
objection, the motion was adopted.
Chiropractic Examiners
Representative Pitts moved the adoption of the following
pending items: Contingency revenue rider to be redrafted to
include administrative penalties and fines. Without
objection, the motion was adopted.
Cosmetology Commission
Representative Pitts moved the adoption of the following
pending items: Prohibit out-of-state travel rider, Require
policies and procedures for overnight travel rider, New
Administrative Technology contingency rider, Performance
measure change to Review and Performance measure change to
number of individuals inspected. Without objection, the motion
was adopted.
Department of Insurance
Representative Pitts moved the adoption of the following
pending item: Performance measures change to review measures.
Without objection, the motion was adopted.
Racing Commission
Representative Pitts moved the adoption of the following
pending item: Revise contingency rider to include additional
strategies rider. Without objection, the motion was adopted.
At 2:51 pm, on the motion of the chair and without objection,
the meeting was adjourned until
