Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Tuesday, March 23, 1999 in the Lt.
Governor's Committee Room, at Austin, Texas.

The Chairman called the meeting to order at 9:10 am. There
being a quorum present, the following business was transacted.
The Chairman laid out SB 63 by Senator Gallegos. Senator
Jackson sent up a committee substitute; Chairman Sibley
recognized Senator Gallegos to explain the difference between
the committee substitute and the bill as filed. Senator
Jackson moved adoption of the committee substitute, without
objection, it was so ordered. Witnesses testifying and
registering on the bill are shown on the attached list.
Chairman Sibley moved that the public hearing be closed;
without objection, it was so ordered. The Chairman moved that
SB 63 be left pending to await a quorum; without objection it
was so ordered. Upon arrival of a quorum, Senator Jackson
moved that SB 63 do not pass but that CSSB 63 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 6 ayes, 0 nays, 0
present not voting, and 1 absent. Senator Jackson moved that
the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
The Chairman laid out SB 551 by Senator Gallegos. Senator
Carona sent up a committee substitute; the Chairman recognized
Senator Gallegos to explain the difference between the
committee substitute and the bill as filed. Senator Carona
then moved adoption of the committee substitute, without
objection, it was so ordered. Witnesses testifying and
registering on the bill are shown on the attached list.
Chairman Sibley moved that the public hearing be closed;
without objection, it was so ordered. The Chairman moved that
SB 551 be left pending to await a quorum; without objection it

Senator Jackson, to explain the bill. Witnesses testifying

recommendation that it do pass and be printed. The motion

and 2 absent. Senator Jackson then moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
Chairman Sibley laid out SB 623 and recognized the author,
Senator Lucio, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
Chairman referred SB 623 to subcommittee for further
consideration. The Chairman appointed Senator Whitmire as
Chairman of the subcommittee and Senators Carona and Madla as
members of the subcommittee.
At 9:50 am the Chairman moved that the Committee stand
recessed until after adjournment of the Senate.
At 12:05 pm the Committee reconvened. The subcommittee report
on SB 456 was laid out by Senator Madla, who explained the
substitute for SB 456 adopted in subcommittee. Senator Madla
moved adoption of the subcommittee report; without objection,
the subcommittee report was adopted. Witnesses registering on
the bill are shown on the attached list. Senator Madla then
moved that SB 456 do not pass but that CSSB 456 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 4 ayes, 0 nays,
0 present not voting, and 3 absent.
The Chairman laid out SB 512 and recognized Senator Madla who
sent up a committee substitute and explained the difference
between the committee substitute and the bill as filed.
Senator Madla then moved adoption of the committee substitute,
without objection, it was so ordered. Rhonda Myron testified
as a resource witness on the bill. Senator Madla moved that
SB 512 be left pending; without objection, it was so ordered.
The Chairman laid out SB 125 and recognized the author,
Senator Lucio, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Chairman Sibley advised that the public hearing would be
closed but that invited witnesses would be heard at the next
hearing on SB 125. The Chairman then moved that SB 125 be
left pending; without objection, it was so ordered.
The Chairman laid out SB 1640 and recognized the author,
Senator Carona, to explain the bill. Witnesses registering on
the bill are shown on the attached list. Chairman Sibley
moved that the public hearing be closed; without objection, it
was so ordered. Senator Carona moved that SB 1640 be reported
favorably to the Senate with the recommendation that it do

favorably to the Senate with the recommendation that it do

At 1:45 pm Senator Sibley resumed the Chair, laid out SB 652
and recognized the author, Senator Carona, to explain the
bill. Stacy Looney, representing Texas Towing & Storage
Association, registered in favor of the bill but did not wish
to testify. The Chairman moved that the public hearing be
closed; without objection, it was so ordered. Senator Carona
moved that SB 652 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 4 ayes, 0 nays, 0 present not voting,
and 3 absent. Senator Carona moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The Chairman laid out SB 121 by Senator Lucio. Senator
Armbrister sent up a committee substitute and moved adoption;
without objection, the substitute was adopted. The Chairman
recognized Senator Lucio to explain the difference between the
substitute and the bill as filed. Witnesses testifying and

Chairman Sibley then moved that the public hearing be closed
and that the bill be left pending; without objection, it was
so ordered.
The Chairman laid out SB 88 and recognized the author, Senator
Carona. Senator Carona sent up a proposed committee
substitute and explained the difference between the proposed
substitute and the bill as filed. At 2:10 pm Senator
Armbrister assumed the Chair and called for witnesses wishing
to testify. Witnesses testifying and registering on the bill
are shown on the attached list. The Chairman moved that the
public hearing be closed; without objection, it was so
ordered. Senator Carona moved that SB 88 be left pending;
without objection, it was so ordered.
At 3:00 pm Senator Sibley resumed the Chair and laid out SB
677 by Senator Jackson. Senator Jackson sent up a committee
substitute and explained the difference between the committee
substitute and the bill as filed. Senator Jackson moved
adoption of the committee substitute, without objection, it
was so ordered. Witnesses testifying and registering on the
bill are shown on the attached list. The Chairman moved that
the public hearing be closed; without objection, it was so
ordered. Senator Jackson moved that SB 677 do not pass but
that CSSB 677 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion

The Chairman laid out SB 1339 and recognized the author,
Senator Carona, to explain the bill. Witnesses testifying and

Chairman moved that the public hearing be closed; without
objection, it was so ordered. Chairman Sibley moved that SB
1339 be left pending; without objection, it was so ordered.
The Chairman laid out SB 1530 and recognized the author,
Senator Carona. Senator Carona sent up a committee substitute
and explained the difference between the committee substitute
and the bill as filed. Senator Jackson moved adoption of the
committee substitute, without objection, it was so ordered.

the attached list. The Chairman then moved that the public
hearing be closed, and that the bill be left pending; without
objection, it was so ordered.
There being no further business, at 4:20 pm Senator Sibley
moved that the Committee stand recessed subject to the call of
