         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Economic  
         Development was held on Tuesday, April 13, 1999 in the Lt.  
         Governor's Committee Room, at Austin, Texas.

         The Chairman called the meeting to order at 9:15 am.  There  
         being a quorum present, the following business was transacted.   
          
         The Chairman laid out SB 748 and recognized the author,  
         Senator Shapleigh, to explain the bill.  Witnesses registering  
         on the bill are shown on the attached list.  The Chairman  
         moved that SB 748 be left pending to await a quorum; without  
         objection it was so ordered.  Upon arrival of a quorum,  
         Senator Whitmire moved that SB 748 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 0 absent. Senator Sibley moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The Chairman laid out SB 1020 and recognized the author,  
         Senator Shapleigh, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Chairman Sibley moved that the public hearing be closed, and  
         that SB 1020 be left pending to await a quorum; without  
         objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Madla moved that SB 1020 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         At 9:20 am Senator Whitmire assumed the chair, laid out the  
         subcommittee report on SB 560 and recognized the author,  
         Senator Sibley.  Senator Sibley sent up a committee substitute  
         and explained  the difference between the new committee  
         substitute and the substitute adopted in subcommittee.   
         Senator Sibley moved adoption of the committee substitute,  
         without objection, it was so ordered.  Senator Sibley then  
         moved that SB 560 do not pass but that CSSB 560 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 5 ayes, 0 nays,  
         0 present not voting, and 3 absent.   
          
         At 9:30 am Senator Sibley resumed the chair, laid out SB 781  
         and recognized the author, Senator Madla, to explain the bill.   
         Senator Madla sent up a committee substitute and explained the  
         difference between the committee substitute and the bill as  
         filed.  Senator Madla moved adoption of the committee  
         substitute, without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Chairman Sibley moved that the public hearing  
         be closed; without objection, it was so ordered.  Senator  
         Madla moved that SB 781 do not pass but that CSSB 781 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 7  
         ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         The Chairman laid out SB 956 and SB 957 and recognized the  
         author, Senator Madla, to explain the bills.  Chairman Sibley  
         then moved that the bills be left pending for further  
         consideration until the Committee reconvened after adjournment  
         of the Senate.  Without objection, it was so ordered. 
          
         The Chairman laid out SB 1251 and recognized the author,  
         Senator West, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list. At  
         9:50 am the Chairman moved  that the hearing on SB 1251 be  
         suspended and that the Committee stand recessed until after  
         adjournment of the Senate.  Without objection, it was so  
         ordered. 
          
         At 12:35 pm the Committee reconvened and testimony on SB 1251  
         continued.  Senator Sibley sent up Committee Amendment 1 and  
         moved adoption; without objection, the amendment was adopted.   
         Senator Sibley requested unanimous consent to incorporate the  
         amendment into a committee substitute;  without objection, it  
         was so ordered.  Chairman Sibley moved that the public hearing  
         be closed; without objection, it was so ordered.  Senator  
         Sibley then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator Fraser  
         moved that SB 1251 do not pass but that CSSB 1251 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 7 ayes, 0 nays,  
         0 present not voting, and 0 absent.   
          
         The Chairman laid out SB 891 and recognized the author,  
  
         Senator Harris, to explain the bill.  Witnesses registering on  
         the bill are shown on the attached list.  Chairman Sibley  
         moved that the public hearing be closed; without objection, it  
         was so ordered.  Senator Fraser moved that SB 891 be reported  
         favorably to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 6  
         ayes, 0 nays, 0 present not voting, and 1 absent.  Senator  
         Madla moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.  
          
         The Chairman laid out SB 1121 and recognized the author,  
         Senator Armbrister, to explain the bill.  Senator Armbrister  
         sent up a committee substitute and explained  the difference  
         between the committee substitute and the bill as filed.   
         Senator Armbrister moved adoption of the committee substitute,  
         without objection, it was so ordered.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Chairman Sibley moved that the public hearing be closed;  
         without objection, it was so ordered.  Senator Armbrister  
         moved that SB 1121 do not pass but that CSSB 1121 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 7 ayes, 0 nays,  
         0 present not voting, and 0 absent.  Senator Armbrister moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chairman laid out SB 1114 and recognized the author,  
         Senator Armbrister, to explain the bill.  Witnesses  
         registering on the bill are shown on the attached list.   
         Senator Armbrister moved that SB 1114 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 6 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator Armbrister moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chairman laid out SB 1676 and recognized the author,  
         Senator Bernsen, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         The Chairman moved that the public hearing be closed; without  
         objection, it was so ordered.  Senator Sibley moved that SB  
         1676 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 0 nays, 0 present not voting,  
         and 2 absent.  Senator Sibley moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chairman laid out SB 1153 and recognized the author,  
         Senator Bivins, to explain the bill.  Senator Carona sent up a  
         committee substitute. Senator Bivins explained  the difference  
         between the committee substitute and the bill as filed.   
         Senator Carona moved adoption of the committee substitute,  
         without objection, it was so ordered.  Witnesses testifying  
  
         and registering on the bill are shown on the attached list.   
         The Chairman moved that the public hearing be closed; without  
         objection, it was so ordered.  Senator Fraser moved that SB  
         1153 do not pass but that CSSB 1153  be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 2 absent.  Senator Armbrister moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The Chairman laid out SB 890, pending in Committee.  Senator  
         Carona sent up a committee substitute. Senator Sibley moved  
         adoption of the committee substitute; without objection, it  
         was so ordered.  Witnesses testifying and registering on the  
         bill are shown on the attached list.  Senator Sibley moved  
         that  SB 890 do not pass but that CSSB 890 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 6 ayes, 0 nays, 0  
         present not voting, and 1 absent.   
          
         The Chairman laid out SB 1468, pending in Committee.  A  
         committee substitute had been sent up and explained  at the  
         hearing on  April 6, 1999.  Senator Sibley moved adoption of  
         the committee substitute; without objection, the substitute  
         was adopted.  Senator Armbrister moved that SB 1468 do not  
         pass but that CSSB 1468 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 2 nays, 0 present not voting,  
         and 0 absent.   
          
         The Chairman laid out SB 88, pending in Committee,  and  
         recognized the author, Senator Carona, to explain the bill.  A  
         committee substitute had been sent up and adopted at a  
         previous hearing.  Senator Carona moved that SB 88 do not pass  
         but that CSSB 88 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 4 ayes, 2 nays, 0 present not voting,  
         and 1 absent.   
          
         The Chairman laid out SB 1643 and recognized the author,  
         Senator Nixon, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Chairman Sibley moved that the public hearing be closed;  
         without objection, it was so ordered.  The Chairman then moved  
         that SB 1643 be left pending; without objection, it was so  
         ordered. 
          
         At 2:00 pm Senator Armbrister assumed the chair and recognized  
         Senator Sibley to lay out the subcommittee report on SB 614.   
         Although the public hearing had been closed in subcommittee,  
         the Chairman reopened the public hearing for invited  
         testimony.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The Chairman then moved that  
         the public hearing be closed; without objection, it was so  
         ordered.  Senator Sibley moved that SB 614  be reported  
  
         favorably to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 6  
         ayes, 1 nay, 0 present not voting, and 0 absent.   
          
         At 2:40 pm Senator Sibley resumed the chair and recognized  
         Senator Madla to continue consideration of SB 956.  Senator  
         Madla sent up a committee substitute and explained the  
         difference between the committee substitute and the bill as  
         filed.  Senator Madla moved adoption of the committee  
         substitute, without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chairman then moved that the public  
         hearing be closed; without objection, it was so ordered.   
         Senator Madla moved that SB 956 do not pass but that CSSB 956  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 7  
         ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         The Chairman again recognized Senator Madla to continue  
         consideration of SB 957.  Senator Madla sent up a committee  
         substitute and explained the difference between the committee  
         substitute and the bill as filed.  Senator Madla moved  
         adoption of the committee substitute, without objection, it  
         was so ordered.  Witnesses testifying and registering on the  
         bill are shown on the attached list.  The Chairman then moved  
         that the public hearing be closed; without objection, it was  
         so ordered.  Senator Madla moved that SB 957 do not pass but  
         that CSSB 957 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 0 absent.   
          
         The Chairman laid out SB 1384 and recognized Senator Fraser,  
         in the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chairman then moved that SB 1384 be left  
         pending; without objection, it was so ordered. 
          
         At 3:35 pm Senator Fraser assumed the chair, laid out SB 1191  
         and recognized Senator Sibley, in the absence of the author,  
         to explain the bill.  Senator Sibley sent up a committee  
         substitute and explained the difference between the committee  
         substitute and the bill as filed.  Senator Armbrister moved  
         adoption of the committee substitute, without objection, it  
         was so ordered.  Witnesses testifying and registering on the  
         bill are shown on the attached list.  At 3:45 pm Senator  
         Sibley resumed the chair and public testimony continued.  Upon  
         completion of testimony, the Chairman moved that the public  
         hearing be closed; without objection, it was so ordered.   
         Senator Armbrister moved that SB 1191 do not pass but that  
         CSSB 1191 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 6 ayes, 0 nays, 0 present not voting,  
         and 1 absent.   
          
         There being no further business, at 5:00 pm Chairman Sibley  
         moved that the Committee stand recessed subject to the call of  
         the Chairman.  Without objection, it was so ordered.
