Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Tuesday, April 20, 1999 in the Lt.
Governor's Committee Room, at Austin, Texas.

The Chairman called the meeting to order at 9:00 am. There
being a quorum present, the following business was transacted.
The Chairman laid out the subcommittee report on SB 697 and
recognized Senator Duncan to explain the bill. The Chairman
moved that SB 697 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,
Senator Carona moved that SB 697 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 5 ayes, 0 nays, 0 present
not voting, and 2 absent.
The Chairman laid out SB 1274 and recognized the author,
Senator Wentworth. Senator Madla sent up a committee
substitute; the Chairman recognized Senator Wentworth to
explain the difference between the committee substitute and
the bill as filed. Senator Madla moved adoption of the
committee substitute, without objection, it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. The Chairman moved that the public hearing
be closed; without objection, it was so ordered. Chairman
Sibley then moved that SB 1274 be left pending; without
objection, it was so ordered.
The Chairman laid out SB 1246 and recognized the author,
Senator Brown, to explain the bill. Witnesses registering on
the bill are shown on the attached list. Senator Sibley moved
that SB 1246 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 7 ayes, 0 nays, 0 present not voting,
and 0 absent. Senator Armbrister moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The Chairman laid out SB 1787 and recognized Senator Bivins.
Chairman Sibley sent up a committee substitute; Senator
Bivins explained the difference between the committee
substitute and the bill as filed.
At 9:50 am Chairman Sibley moved that the Committee stand
recessed until after adjournment of the Senate and that
consideration of SB 1787 continue at that time; without
objection, it was so ordered.
At 1:35 pm the Committee reconvened and consideration of SB
1787 continued. Witnesses testifying and registering on the
bill are shown on the attached list. Chairman Sibley moved
that the public hearing be closed; without objection, it was
so ordered. Senator Armbrister sent up Committee Amendment 1
and moved adoption; without objection, the amendment was
adopted. Senator Armbrister sent up Committee Amendment 2 and
moved adoption; without objection, the amendment was adopted.
Senator Armbrister sent up Committee Amendment 3 and moved
adoption; without objection, the amendment was adopted.
Senator Armbrister requested unanimous consent to incorporate
the amendments into a committee substitute; without
objection, it was so ordered. Senator Armbrister then moved
that the new committee substitute be adopted; without
objection, it was so ordered. Senator Armbrister moved that
SB 1787 do not pass but that CSSB 1787 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 7 ayes, 0 nays, 0 present
not voting, and 0 absent.
The Chairman laid out the subcommittee report on SB 508 and
recognized the author, Senator Bivins. Senator Bivins
explained the committee substitute as adopted in subcommittee.
Bill Powers, representing the Texas Farm Bureau, registered in
support of the bill but did not testify. Chairman Sibley
moved that SB 508 be left pending; without objection, it was
so ordered.
The Chairman laid out the subcommittee report on SB 776 and
recognized the author, Senator Bivins, who explained the
committee substitute which had been adopted in subcommittee.
Senator Fraser moved that SB 776 do not pass but that CSSB 776
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 7
ayes, 0 nays, 0 present not voting, and 0 absent.
The Chairman laid out SB 1384, pending in Committee, and
recognized the author, Senator Shapleigh. Senator Sibley sent
up a committee substitute; Senator Shapleigh explained the
difference between the committee substitute and the bill as
filed. Senator Sibley moved adoption of the committee
substitute, without objection, it was so ordered. Senator
Sibley moved that SB 1384 do not pass but that CSSB 1384 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 7
ayes, 0 nays, 0 present not voting, and 0 absent.
The Chairman laid out SB 497 and recognized the author,
Senator Shapleigh, to explain the bill. Senator Armbrister
sent up Committee Amendment 1 and moved adoption; without
objection, the amendment was adopted. Witnesses testifying

Senator Shapleigh. Senator Shapleigh explained the difference
between a proposed committee substitute and the bill as filed.

The Chairman laid out the subcommittee report on SB 532 and
recognized the author, Senator Ratliff, to explain the bill.
The Chairman moved that SB 532 be left pending to await a
quorum; without objection it was so ordered. Upon arrival of
a quorum, Senator Jackson moved that SB 532 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 4 ayes, 0 nays, 0
present not voting, and 3 absent.
The Chairman laid out HB 2450 and recognized the Senate
sponsor, Senator Jackson, to explain the bill. Witnesses
testifying and registering on the bill are shown on the
attached list. Chairman Sibley moved that the public hearing

moved that HB 2450 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,

recognized the author, Senator Armbrister. A committee
substitute had been adopted in subcommittee and Senator
Armbrister explained the difference between the committee
substitute and the bill as filed. Dianna Doss, representing
the Texas State Florists' Association, registered on the bill
but did not wish to testify. The Chairman moved that SB 169
be left pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Armbrister moved
that SB 169 do not pass but that CSSB 169 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 4 ayes, 0 nays, 0
present not voting, and 3 absent. Senator Armbrister moved
that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.

committee substitute and explained the difference between the
committee substitute and the bill as filed. Senator Carona

Senator Fraser. Senator Fraser sent up a committee substitute
and explained the difference between the committee substitute
and the bill as filed. Senator Fraser moved adoption of the

moved that SB 1063 do not pass but that CSSB 1063 be reported
back to the Senate with the recommendation that it do pass and

The Chairman laid out the subcommittee report on SB 623 and
recognized Senator Whitmire, Chairman of the Subcommittee on
SB 623, to explain the subcommittee report. A proposed
substitute had been adopted in the subcommittee meeting on
April 12. Senator Whitmire sent up a new committee
substitute; the Chairman recognized the author of SB 623,
Senator Lucio, to explain the difference between the committee
substitute and the bill as filed. Senator Whitmire moved
adoption of the committee substitute, without objection, it
was so ordered. Witnesses registering on the bill are shown
on the attached list. The Chairman moved that SB 623 be left
pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Whitmire moved
that SB 623 do not pass but that CSSB 623 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 4 ayes, 0 nays, 0
present not voting, and 3 absent. Senator Whitmire moved that
the bill be recommended for placement on the Local &

The Chairman laid out the subcommittee report on SB 1344 and
recognized Senator Armbrister to explain the bill in the
absence of the author, Senator Brown. Senator Armbrister
moved that SB 1344 be reported favorably to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a vote of 4 ayes, 0 nays, 0 present not voting,
and 3 absent.
The Chairman referred SB 1029 and SB 1030 to the Subcommittee
on Technology and Business Growth for consideration.
There being no further business, at 4:00 pm Chairman Sibley
moved that the Committee stand recessed subject to the call of
the Chairman. Without objection, it was so ordered.
